Move is on for non-court Florida foreclosures
A proposal by the Florida Bankers Association to allow foreclosures without a court hearing is arousing violent sentiments on both sides of the issue in Southwest Florida.
Proponents say so-called “non-judicial” foreclosure, which would take as little as four months, could help clear a glut of court cases and speed the recovery of the housing market.
Opponents say it’s a way for banks to take people’s houses without legal safeguards built into the court system – even when a lender’s claim to foreclose is shaky.
“They’re trying to keep people from their day in court,” said real estate agent Jeff Tumbarello, who tracks foreclosures in Lee County and is director of the Southwest Florida Real Estate Association.
“They’d prefer not to face a judge with what they do to people,” Tumbarello said.
He noted that in recent court cases, judges in Florida have thrown out foreclosure suits because the bank couldn’t prove it owned the loan.
But county Clerk of Court Charlie Green, who’s struggling to stay ahead of a flood of new foreclosures and a 23,000-case backload, said “there should be a way to foreclose quickly against deadbeats who are destroying neighborhoods by neglecting or abandoning their homes”.
“There are people who have not made any payments, any effort to pay, and they’ve been living there a year to a year and a half and not helping anybody,” he said. “I agree with the banks: Those people need to go.”

Destroying neighborhoods? By not paying the mortgage payments and spending the money other places in the community, sounds a lot like the “stimulus package” designed to help our local economy – which was the root of the problem in the first place- I don’t see how not paying the mortgage payment is destroying the neighborhood! Bad economic times and lack of jobs is destroying the whole country. Does that make us deadbeats for living here in the U.S.A. They are foreclosing on the property and taking all of our equity and our down payments, closing-costs we paid, all the payments we made for mostly interest and insurance”very little came off the principal” that we paid with the net pay we received after our paychecks were taxed and we are still responsible for the amount un-paid on the mortgage and the atty. fees and court costs and now they want to rush us out without even one day in court- TAXATION WITHOUT REPRESENTATION! Russia is probably nice this time of year!
Green should be happy he has a job in this economy–even if he does not do it with the people of Florida’s best interest. He needs to quit complaining of to much work with foreclosures and forclose on the causes of Lee county’s lost of income, Floridians moving out of the state etc.
Typical Politican: take the focus off himself and pass the buck to us–the residents of lee county.

Poor Charlie Green has to finally do some work as he calls his fellow citizens deadbeats vote this jerk out as he probably goes home at night and kicks his pet.

There is a way to foreclosure in 4 to six months it’s called default! Leave the rest to their day in court in front of a judge. The fraud and schemes of these crooks (banksters and attorneys) need to see the light of day.

Mr.Green I hope for your sake you never have to suffer thru the agony of losing your home and those same Deadbeats that you are referring to have probably paid for you to keep your house or a roof over your head for all the years that you have been paid thru taxpayer dollars. There will always be people that will work the system.Look around you.Look at the Banks & the elected officials in your state and Washington. The banks are taking peoples homes that have no legel right or standing to do it and in most cases have been paid and in some cases more than once.How would you like for someone to lay claim on your place without legel right to do so.The banks, Wall street have been paid and they want to be paid again. Well you are well in right that something has to be done, With state & federal officials following the law period.It is not a gray area.Its there.It just needs to be followed. Not changed.Banks show the legal standing and that you are the owner of the true note and then do what you have to do.
