We have been sitting on this information for some time now due to ongoing investigations but since the cat is out of the bag here we go…

Bombshell- Substantiated Allegations of Foreclosure/Affidavit Fraud That Implicates the Florida Attorney General’s Office

I’ve said it before and I’ll say it again, the attorneys at Ice Legal may be the most aggressive and hard charging Foreclosure Fraud Fighters in Florida.  When this whole system comes crashing down and when judges and the Florida Supreme Court put an end to the systemic abuses of the court process being perpetrated by the foreclosure mills, the attorneys at Ice Legal will rightly take their fair share of the credit.

Attached here is a must read Motion along with a copy of a transcript from a hearing held in a Volusia County Courtroom.  The Motion lays out a very disturbing set of allegations…

This is a foreclosure action filed by WELLS FARGO BANK, NA (the “BANK”). The BANK is represented by Florida Default Law Group, P.L. (“FDLG”). On behalf of the BANK in this case, and on behalf of other clients in other cases, FDLG filed affidavits to establish that the attorneys’ fees it was allegedly paid were reasonable. The affidavits purport to have been executed by Lisa Cullaro, the appointed expert on attorneys’ fees. The notary who allegedly administered the expert’s oath and vouched for her signature was Erin Cullaro, a former employee of FDLG and now an Assistant Attorney General in the Economic Crimes Division of the Office of the Attorney General.

Economic Crimes Division. The same Economic Crimes Division that investigates firms like the FDLG?

Not only was Erin just a former employee, it looks like she was one of the lead counsel for Michael Echeverria, the owner of FDLG (Florida Default Law Group)

The public records request also revealed that Ms. Cullaro completed a “Request for Approval of Dual Employment” (From the Florida Attorney General’s Office) in which she certified that her secondary job notarizing documents “does not create a conflict of interest (as specified in Chapter 112, Part III, Florida Statutes) nor the appearance of impropriety…”  Ms. Cullaro’s dual employment was limited to Mondays, Wednesdays and Fridays between 7:00 p.m. to 7:15 p.m. Defendants proffer that they will show affidavits executed on days other than those approved by the Office of the Attorney General and that travel records suggest that Ms. Cullaro would have not been present in Florida on the date and time that an affidavit was notarized.

Here are the signatures to compare…

Focusing just on Erin Cullaro, the sampling of her alleged signatures below, demonstrate remarkable differences. And while, she proffers that she has abbreviated her signature over the years, the sampling reveals that more than one “abbreviated” signature has appeared over her signature line.

Indeed, if the signatures are fraudulent, proof of the intent to defraud may well hinge on the fact that these signatures were on documents used as summary judgment evidence in a court of law.
In any event, not all the signatures in Defendants’ collection are from affidavits. Obviously, Defendants should be permitted to inquire as to the obvious differences in signatures purporting to be that of the witnesses, regardless of where those signatures were made.

So the allegations made in this Motion are that Affidavits are being submitted in courtrooms across the state and Ice Legal questions the veracity of those affidavits.

  • They have compared the alleged signatures and do not believe the signatures were made by the person allegedly signing.
  • They have compared dates and determined that the Affiant or Signer was not in the state on the date of the alleged signing.
  • An attorney who works in the Office of the Florida Attorney General is executing documents that are being used to take homeowner’s homes from them.
  • Allegations of foreclosure fraud permeate the entire foreclosure case file in the form of other questionable documents, affidavits and assignments.

Why isn’t the Florida Attorney General’s Office doing more to protect citizens from foreclosure fraud and foreclosure rescue fraud?

And now the bombshell….Florida Default Law is fighting like bloody hell not to have these depositions taken….they’re filing Motion after Motion and have made it quite clear that they have no intention of ever letting these witnesses be sat for deposition.

What does it say about how deep this rabbit hole goes when attorneys are refusing to answer any questions relating to evidence they created and have filed in courtrooms across the state?

What does it say when attorneys are ignoring court orders to have their depositions taken after a judge has heard their objections and found them without merit?

What does it say about how many layers their are on this stinking onion when the Florida Attorney General’s Office is implicated in allegations of fraud on the Courts of this state?

You cant make this stuff up folks. This is better than a Steven King Novel!

    To whom it may concern,
    Due to Hurricane Ivan and an immediate job loss, my husband (Jackie Glen Waldon) and I (Imanda Carroll Waldon) got behind on our mortgage payment. I made numerous calls to Citi Mortgage to modify our mortgage loan. Since we have been with this mortgage company, we have been paying 11% interest and hardly any money has come off the principal. We have lived in our home for 16 years. Citi Mortgage proceeded with the foreclosure process. We hired a Chapter 13 attorney/Foreclosure Representative to assist us in fighting the mortgage company to dismiss the accelerated interest fees; our total debt not including our mortgage was less than $17,000.00. We went from owing one mortgage payment to owing the mortgage company over $11,000.00. Because of this, we were forced into a Chapter 13 to save our home. My husband and I believe in paying our debt, we went in the Chapter 13 to pay 100%. Fifty three months later and pure hell, we have paid over $31,000.00 to the Chapter 13 program and we have paid Citi Mortgage over $30,000.00. This has not included the cost of living and raising a teenage child. My husband and I only make fifty thousand dollars a year. We have been so strapped by this program and our mortgage company charging us so much interest. We can’t even afford to pay our property taxes and insurance because most all of our money goes to the Trustee and Mortgage Company. I have pleaded with the mortgage company to re-evaluate our mortgage and include our taxes and insurance. After paying over $60,000.00 in cash to save our home, on December 31, 2009, CitiMortgage has proceeded forward in foreclosure. (We only owe $62,000.00 on our home). January 2010, I called to make our monthly mortgage payment and they would not accept the payment. We have been making our mortgage payments each month along with our Chapter 13 payment. The Trustee is stating that we will be out of the Chapter 13 in October 2010, about $38,000.00. My husband and I don’t understand why we are paying so much money that we didn’t owe. The Trustee states that they can allocate additional interest to debtors and we feel like we are being raped not to mention could still lose our home. We have been making our payments. With the economy so bad and foreclosures ski high, why would they not work with us and not accept our money. The Trustee has already paid Citi Mortgage over $11,000.00 in accelerated interest fees of our money. None of that money came off our mortgage. To date, we have paid the mortgage company over $40,000.00 in cash and within 53 months. We are asking for help to help us modify our loan to an acceptable interest rate to include our insurance and property taxes. We love our home! We have raised our children in our home. I have recently lost my job due to the mental stress and exhaustion this has put on us. We can’t continue to throw our money away. We are in our mid forties and we are trying to plan for our future.
    Thank you in advance for consideration of our case. We have paid our debt in full and we need to save our home. The Chapter 13 attorney did not advise us that we will still have 10 years of bad credit ONCE /IF we are discharged from this Chapter 13. These programs should be illegal and mortgage companies should not be allowed to charge interest rates that WILL NOT ALLOW YOU TO PAY OFF YOUR HOME! These folks are getting rich because of people like us and what happens to the little folks….HOMELESS IN MILTON, FLORIDA. Please contact me for further details and information.

    I am being foreclosed by J.P. Morgan , represented by the Florida Default Law Group, P.L. In my opinion, they have created and filed in public records a fraudulent assignment, created by the Plaintiff’s attorneys after the fact, possibly backdated, and signed by two ladies as Vice Presidents and Asst. Vice-Presidents of Home Savings of America F.A. on Dec. 22, 2008. Home Savings of America ceased operations in 1998. These ladies either work for a “signing mill” or are employees of the Plaintiff, J.P. Morgan. I believe they are employees of J.P. Morgan. There is also the possibility that someone forged their signatures. J.P Morgan, the FDLG and Albertelli Law refuse to admit that these ladies are employees of J.P. Morgan, yet on Facebook and other sites they list their employment as J.P. Morgan. The assignment also breaks the chain of ownership. I believe it is fraud on the Court and conspiracy between the Plaintiff and their counsel in an attempt to deny me the right to due process.

      Check up on the State Dept Corporation register for ” Home Savings of America F.A” . This register has the corporation profit statement ,and the Corp. officers are listed. If your two VP’s aren’t there , then you’ll have a second piece of proof that the VP’s are only forgeries ..ficticious signers . Check out Florida Statutes Chap 831.01 forgery , Chap. 831.02 and Chap. 831.06 Ficticious signatures of officers of Corporation ..

    There’s also been a hidden conflict-of-interest that’s been creeping behind the scenes that would probably explain criminal actions by your AG and Judiciary(or anyones for that matter). every state has their own PERS Public Employee Retirement System(your’s might be different), and one of the things these investment bankers did to try and get away clean by throwing a wrench into the machine was gamble with these pension funds on other real estate investment deals and pocketed millions in fees for setting up the deals. These “investments” took HUGE losses which means that pension funds(ie judges legislators AGs) took huge losses because borrowers are unable to make payments and what not, so because they are all caught up in the middle of it do you think they are going to be understanding? HELL YES IT CREATES A VERY BIG CONFLICT OF INTEREST, but now all they can think about is “those damn lousy borrowers” and they tell their new investment advisers(because the old ones ran off like bandits) “get out there buy foreclosure, resale and make me profit damn it, I wanna retire”.

    Great article as usual! The fraud is being exposed all over the place, but I wouldn’t necessairly count on the FBI to do their job without being forced to. Allow me to explain: Wells Fargo; Through their assigned counsel, Florida Default Law Group (FDLG)had me served last week to begin the foreclosure process. Knowing about how they are commiting MANY crimes to foreclose on people, I asked the FBI to open an investigation into the use of counterfeit securities by FDLG in the foreclosure process. The investigator questioned me for over 20 min. and although I pleaded with him to meet with me in order that he may view the su bstantial documentation I had supporting my allegations, he simply refused. What’s more, when I sent the packet of information to him certified mail, it was accepted by the secretary and returned by the agent unopened. Now, Don’t these folks have some kind of responsibility to investigate a reported crime?

      I would say that was unbelievable if the same thing didn’t happen to me by 1. a cop, 2. a lawyer 3. a slumlord, and 4. a judge. And an assistant district attorney. It must be a southern thing.
      Y’all it’s just to darned hot to look at all this here pesky evidence.
      They slide your documentation right back at you. That way if they are questioned by somebody who actually gives a damn, they don’t have to add perjury to their list of offenses.
      Try email. Who doesn’t check their email?
      Also, try the IRS. Any money crimes include tax fraud.

    We have these same two signatures (same last names – family cannot notarize for each other) when U.S. Bank NA filed a foreclosure suit against us in 2007 – 2008. We just discovered these signatures the other week at the court house.

    Hello from Maine!

    I have a foreclosure pending her in Maine, I have gone over all the information on this site and Neil’s…Is it possible that the mortgage fraud you are talking about in Florida be of the same here in Maine??
    I’ve looked up my records in my county and found that my mortgage originally with Union Federal Bank of Indianapolis has been assigned to MERS/nominee for CitiMortgage, I went further and found that the one claim to be the vice president of Union Federal is also the vice president for a bank called Chase Financial LLC, then further into my search I found that this same person works for National Title Clearing, all stating their from Palm Harbor Florida county of Pinella…Im am totally confused! I have a FHA loan which says that my Mortgage is owned by Ginnie Mae GNMA.
    Any help or direction would be greatly appreciated!!!
    I do have an attorney, one I believe that doesn’t get it.

    Thank-you for this wonderful site, it’s like a life line for someone in a sinking ship.

    • Look for depositions coming soon of Robosigners from National Title Clearing House, they are a document mill here in Pinellas County…as we know from other depositions, the document mills get instructions from the attorneys about what the attorneys need the documents to say in order to substantiate their foreclosure cases then the robo signers at the mills sign the documents that the word processor spits out…..stay tuned.

        If this is the case, then there are hundreds in my small town of 1200 who have these same people listed on their mortgages and don’t even know it’s happening to them…”UNBELIEVABLE”

        Boy, would I love to call the local media and blow the top off this mess…

        My lawyer wants me to pay the reinstatment fee of $7700.00(which includes CitiMortgage lawyer fees) to bring my mortgage back to good standing and continue on my merry way!!!!
        Yes, this would save my home, but knowing Im being had is not sitting with me well…

        I know they have operations in FL (et al) – they churn out 10’s of thousands of docs per month. I know… I used to work there – title examiner – but asked too many questions about MERS and was relieved of my duties (AKA S**T-CANNED)!!!

      Yes, they are all in it together. My mortgage is with CitiMortgage in Fl. Ever since they slipped in a got our mortgage, I have been fighting for 8 years. Paying an attorney 5 of these. They dont get it either. If it is not to late for you…..look up your local Credit Consumers of America (make sure they are HUD Certified) and they will blast them out the water. After $60,000.00 trying to save our home within 53 months, in five minutes, they had State Investigators looking for fraud. Within 5 days, CitiMortgage is trying to neg/ with us…..even to the point that they just left me a recorded message stating that they have our completed application for a loan modification. Funny thing…..we have not filled out anything! Dont give up!!!!!!

    Finally! Someone has enough wit about them to expose this horrific rape of the american homeowner to the core! How about a class action? I have been waiting since november to receive my mortgage docs from countrywide aka bank of america. I cant wait to finally find out who is pretending to own the note and if it has been bailed out…and how many times! How much do you want to bet the banks are owners (at some hidden level but nonetheless owners) of the florida default group. They own every one and everything else it seems. Thank you ICE law for caring enough and for being BRAVE enough not to sweep all of this under the rug, like every one else is doing!
    If any one has a class action to go after countrywide aka bank of america (they wouldnt modify for over a year) for fraud and unscoupulous appraisals, documents, and all the stress- please let me know!!
    It is time to put a halt to what the crooks are doing to cover up the rapes…thanks to ICE Law, they know they will leave some dna behind! Debi J
