The chairman of the Republican Party in Macomb County, Michigan, a key swing county in a key swing state, is planning to use a list of foreclosed homes to block people from voting in the upcoming election as part of the state GOP’s effort to challenge some voters on Election Day.

“We will have a list of foreclosed homes and will make sure people aren’t voting from those addresses,” party chairman James Carabelli told Michigan Messenger in a telephone interview earlier this week. He said the local party wanted to make sure that proper electoral procedures were followed.

State election rules allow parties to assign “election challengers” to polls to monitor the election. In addition to observing the poll workers, these volunteers can challenge the eligibility of any voter provided they “have a good reason to believe” that the person is not eligible to vote. One allowable reason is that the person is not a “true resident of the city or township.”

The Michigan Republicans’ planned use of foreclosure lists is apparently an attempt to challenge ineligible voters as not being “true residents.”

One expert questioned the legality of the tactic.

“You can’t challenge people without a factual basis for doing so,” said J. Gerald Hebert, a former voting rights litigator for the U.S. Justice Department who now runs the Campaign Legal Center, a Washington D.C.-based public-interest law firm. “I don’t think a foreclosure notice is sufficient basis for a challenge, because people often remain in their homes after foreclosure begins and sometimes are able to negotiate and refinance.”

As for the practice of challenging the right to vote of foreclosed property owners, Hebert called it, “mean-spirited.”

GOP ties to state’s largest foreclosure law firm

The Macomb GOP’s plans are another indication of how John McCain’s campaign stands to benefit from the burgeoning number of foreclosures in the state. McCain’s regional headquarters are housed in the office building of foreclosure specialists Trott & Trott. The firm’s founder, David A. Trott, has raised between $100,000 and $250,000 for the Republican nominee.

The Macomb County party’s plans to challenge voters who have defaulted on their house payments is likely to disproportionately affect African-Americans who are overwhelmingly Democratic voters. More than 60 percent of all sub-prime loans — the most likely kind of loan to go into default — were made to African-Americans in Michigan, according to a report issued last year by the state’s Department of Labor and Economic Growth.

    What’s the difference who you vote for, the banksters own them all anyways, we have 1 party rule here in the new united states of amerika, the banksters. They get to counterfeit money from thin air, they get to use this “money” to buy votes in CONgress, and pretty much do whatever the hell they want. It is the people vs the banks, in the final knock down drag out battle !!

    Just wondering, if no one voted or hardly anyone voted in the upcoming elections if that would send a powerful message to Washington. Republican , Democrat, they are all the same to me. I have lost complete faith in everything . This may sound jaded but to me these people are all the same. There seems to be rampant corruption everywhere from the top down. No checks or balances anywhere for these WALL STREET CROOKS AND BIG BANKSTERS. How can we have a civilized society when the system is so broken and corrupt to its very core? Media around the world and a few of our mainstream news media, are telling the truth about FORECLOSUREGATE and showing this once great country is merely a shell of what it once was.

    They did try to remove our homestead but I kept calling and went to the tax appraisers office until they put it back on. The fat lady hasn’t sung here yet…

    The interesting part …

    The use of foreclosure lists would be a new form of what is called “caging,” or systematic efforts to disenfranchise voters on technicalities — something the RNC has been caught doing several times in the past and has promised in judicial consent decrees not to do anymore.

    Hebert, who spent two decades in the Justice Department under Republican and Democratic presidents alike, much of that time in the Voting Rights Division, placed this latest skirmish in the context of a long history of similar efforts by the GOP, writing on his blog that “the GOP has a long history of engaging in voter suppression efforts. The Party has persisted with the practice because it has proven effective. The GOP schemes have also led to injunctions being imposed by the courts barring specific voter suppression efforts. If the claims of possible vote challenges to those who have received foreclosure notices were against a clean historical slate, then such claims might be a little hard to believe. But they aren’t. They arise against a stain of GOP vote suppression extending over a number of decades.”

    In Florida, many property appraisers are unilaterally cancelling homestead exemptions without cause when a home goes into foreclosure, This allows the county to raise your property taxes. Additionally, the foreclosure mills do not have follow the Supreme Court Amendment to the Florida Civil Rule 1.110.

    They missed a way more obvious tie to foreclosure/mortgage world than where McCain’s MI HQ was. One of McCain’s top “bundlers” is Alberto Cardenas. Cardenas sat on the Board of Directors of Fannie when Fannie started securitization in the 80’s and dramatically ramped up Fannie’s funding. He went on to become a lead Fannie lobbyist and, last I checked, he still is.

    Cardenas is a partner at the law firm of Tew-Cardenas. So who is Tew? Well, there are two. One is Mike Tew; he is one of the lead investigators for the Florida Bar and also was one of the five people that distributed the Drexel money after Milken went to prison. The other is Jeff Tew; he’s David Stern’s lawyer and mouthpiece.

    There was nothing especially secret about that, except maybe the link to Stern though Tew has represented him for years — got him off the hook for filing false affidavits, which Stern pled guilty to and promised not to do again — about a decade ago.
