Send whatever letters, files, loan paperwork, anything that you can send to them and let them know that you want serious action taken against the lenders as well as serious protection for those who are being denied their due process of law. We must all let the politicians know that we want action…not a pat on the head and a counseling session to make it all better. Mediators giving the lenders their little “green light” certificate to foreclose, does not, in fact, give you due process of law you. They will tell you it does. Why the fuss?
How all of this has even gotten to this point is beyond my comprehension. Credit card laws are enacted to protect consumers against interest rate abuses yet mortgage fraud by lenders isn’t a big deal. Isn’t it just business as usual. Why the fuss?
All kinds of protections and legislation against identity fraud but shell coroporations and made up robo-signers transferring, selling, satisfying mortgage notes, and more is fine and dandy. Avoidance of paying county recording fees while in the process breaching the very foundation of real property laws. Why the fuss?
Glaring fraudulent mortgage notes, errors in loan paperwork, counterfiet mortgage notes, made up appraisals, misrepresentation, forged loan documents, backdated assignments, non-disclosures of every type and kind, conflicting sets of mortgage documents riddled with errors and deletions, broken chains of title, vulnerability to deficiencies down the road, inability to get title insurance and lots more. Why the fuss?

I keep getting fraudulent credit card bills too that are not accurate. Way more sometimes twice what I owed. My son and my husband too. What are they doing? I think they are trying to force us to file BK so they can discharge all of their criminal activity. That is all I can take from it. I would like make you aware of a request which I have submitted to the Congressional Oversight Panel. Every homeowner who fraudulently has no legal interest in their property has a right to have state and federal taxes they paid as homeowners, refunded. As in my case, I have never had any legal interest in my home, because of MERS hiding securitization transactions. Please feel free to use this email in any form you would like.
I, for one, am sick and tired of Wall Street defrauding me, while the government turns a blind eye. Maybe if they DO go bankrupt because of Wall Street’s corrupt practices, they will finally put the appropriate parties behind bars. What is the government planning on doing to resolve tax issues created by MERS? Many of our loans, such as mine, were sold and securitized before they were ever signed. In my case, the property has been encumbered by at least two prior MERS transactions which were fraudulent. By operation of law, they are void, and create a tenancy-at-will. I have been paying taxes on a property I have never legally owned any interest in. I have retained an attorney, and shall be applying to get those taxes back, since I was not the party legally responsible to pay them. Since many of the responsible parties are trustees and REMICs, they are tax-exempt. The US government is looking at possibly billions of dollars in lost tax revenues. MERS has had their hands in so many securitized mortgages, that this could bankrupt many states, and possibly the government. The SEC has known about this practice since at least January of 2003.
AS A NOTE TO EVERYONE: The information contained is my actual identification. Do not hide behind anonymity. With the Implosion of MERS, and all the garbage loans the Federal Reserve bought from banks who used MERS, the government has more to fear from us. Anyone who’s loan was sold and securitized before you signed it, has the right to recoup ALL state and Federal taxes you paid. Your mortgage docs are void by operation of law. Demand your taxes back. When the government starts losing all this tax revenue, on top of all the money they have lost by purchasing worthless loans, they will be forced to get it from the Wall Street banks. This is the only way that they will go after them, like they should have done 3 years ago. The government was a prime mover in this fraud. The SEC and The Office of the Comptroller of Currency, has known about it since 2003, and allowed this practice. Fannie and Freddie helped establish MERS. Treasury has bailed them out with our money, because of their practices. This racketeering in it’s most perverse form.

Sorry, but I’m a little confused here. What makes you believe your loan was sold and securitized before you signed it? Before you sign the promissory note, there is no loan. And what taxes do you believe you have paid on your property? I’m honestly not aware of any property taxes charged at the national/Federal level.
I’m not trying to suggest that you and your lawyer may not have a case here, I’m just really not understanding those two parts of the complaint.
The answer to your question is looking at the closing docs (I have outlined on the message board how to check this), and at the PSA (closing and cutoff dates) of the securitization.
You are correct there is no loan before you sign the promissory note…that is the point. They do sell it. Look at the Jan 2003 SEC Special Report of the Tasf Force on MBS Disclosure. It is available on their site. They mention the practice on 4 seperate occasions. When they sell your loan before it is signed, it is a “Tenancy at will”., you own nothing because it is void by operation of law. If you do not believe this happens regularly, you need to review the landmark decision “In Re Agard”.
Your property taxes are claimed on both your state and federal returns, as is mortgage interest. As is your electric, sewer, water, etc. When you are a tenant, the landlord is responsible for those payments. Let the state and town figure out who owns the home. They can’t do it through the Registry of Deeds anymore because they allowed MERS to record inaccurate documents of ownership. The records for my house have been incorrect for the last 7 years because of MERS. There were 3 public transfers, and all three were fraudulent as to ownership.

I had no idea loans were sold before they even became loans. I still don’t understand how that can happen. What if the deal falls apart at closing? It’s rare, but it does happen.
We’ve owned our home for 20 years – just paid it off last Friday. During that time, we took an overseas assignment and rented out our home for three years while we were away. At that point we were able to deduct things like utilities, which you mentioned, but not when we were residing in the home.
We were lucky. We had two nasty bad experiences in the late 80’s and early 90’s with totally bungled paperwork when our mortgages were sold. So when we refinanced in ’99 to a 15 year mortgage, we went with the credit union, even though their rates were a point or two higher than other lenders, simply because they assured us that they had never sold a loan they had made to a member. We received our original, blue-ink “Paid in Full” note and deed on Monday, one business day after paying off the mortgage. I’m afraid that’s a thing of the past.
I have siblings in CA who are miles upside down on multiple houses and haven’t a prayer of getting their lenders to work with them so I’m very sympathetic to anyone battling the banks.

This clip pretty much tells it like it is and that is how we are all feelling these day. It is freaky how spot on it is about the way things are today. Was someone trying to tell us all something? Maybe. I can’t remember times being so bad and either can my parents. My grandparents probably could because they grew up during the Great Depression but they have been gone for 3 years now. My Grandmother lived in fear her whole life it seemed of credit, putting money in a bank and had a general great distrust of the Government . I wish they were still with me today because they had and always shared such great wisdom with me. We are all mad as hell and not going to take it anymore so what now? The people are in need of some leadership and organization. .Remember the hippies of the 60’s and the civil rights movement? They got the job done then or this might have happened to all of us a long time ago.

Citi Vs Zeller The court recorder did a great job. The judge accepted a fraudulent affidavit – fraudulent by time of notary vs entries that were made AFTER the notarizing took place. The judge let Citi lie and he gave them a summary judgement based on CR 56. I had over 60 relevant exhibits. In his decision, the judge wrote a revision to what the transcript says and does not discuss how the fraudulent affidavit from Citi was accepted, the proof of payment attemps madeby the defendant and denied by Citi and the loan modification tactics Citi used – were all ignored by the Magistrate. A summary judgement! Citi’s name does not EXIST on the documents at the County Court Recorders office.
I actually think the goal of our government is for every american to be homeless and food stamp dependant. Don’t they realize that by destroying the public sector they are destroying america? How long is this going to go on? Look at the bailouts. I believe the US shortly will erupt like the Middle East on the course we are heading. I don’t know about you guys, but most people I speak to, hate the government (not the country, though). I hate to say it, but Osama won. Our democracy has fallen since 9/11. The government seems to have used that episode to crack down on our freedoms, rights, and liberties. Tim, very, very true, although it may have accelerated after 9/11, it started to erode decades ago! And I have been saying for about 2 years now, if something didn’t change in this country, there would be another civil war. Not if, but when. I really don’t want to see it in my life, but fear it is right around the corner. I have two worse judges listed in this website in 2010. Both of them the FIRST in this list. Judge Corrigan from the US District Court (Jacksonville) & State Judge Taylor look like normal people, even …charming! But they are the worse! What else can we do? Check your spending. I was witnessing: one woman started car and going to ride. I stopped that she can ride from her yard freely. But she stopped near her mailbox, took the mail and ride back into garrage! Can you imagine??? GASOLINE = BLOOD! Blood of our Am. soldiers who fight for “freedom” of OUR (!) country in OILY lands. Can you stop to use your car riding from bedroom to bathroom? If you have your job just a few blocks away, can you walk? Think about it. Maybe, if you will not ride at least one day (Saturday, for example), it could be enough to pay a mortgage?
