Berger & Montague, P.C. Files Class Action Lawsuit Against CitiMortgage, Inc. on Behalf of Pennsylvania Homeowners

PHILADELPHIA, PA, April 5, 2011 (PRNEWSWIRE) — The law firm of Berger & Montague, P.C. has filed a class action complaint in the United States District Court for the Eastern District of Pennsylvania on behalf of all Pennsylvania homeowners whose mortgage loans have been serviced by CitiMortgage, Inc., and who, since April 13, 2009, (1) have entered into a Trial Period Plan (“TPP”) Contract with CitiMortgage and made all payments as required by their TPP Contract and complied with CitiMortgage’s requests for documentation, and (2) have not received or have been denied a permanent Home Affordable Modification Agreement that complied with the U.S. Department of the Treasury’s Home Affordable Modification Program (“HAMP”) rules.

The Complaint alleges that CitiMortgage accepted billions in government bailout money under the Troubled Asset Relief Program (“TARP”) earmarked to help struggling homeowners avoid foreclosure. CitiMortgage, like other TARP-funded financial institutions, is contractually obligated to modify mortgage loans it services for homeowners who qualify under HAMP, a federal program designed to abate the foreclosure crisis by providing mortgage loan modifications to eligible homeowners.

According to the lawsuit, CitiMortgage systematically slows or thwarts homeowners’ requests to modify mortgages, depriving borrowers of federal bailout funds that could save them from foreclosure. The bank ends up reaping the financial benefits provided by TARP-funds and also collects higher fees and interest rates associated with stressed home loans.

    Does anyone know of any open class action suits against citi mortgage? I am having the hardest time getting a mod and the run around is crazy! Requesting the same forms over and over meanwhile I am still paying this high mortgage. Did I mention I started my mod in 2012 and it still hasn’t been approved?

    We need to find out who has a class action lawsuit against CITI open right now I have recordings that can be use for media attention with the law suit they are admitting to defrauding the government and home owners who has a open lawsuit please contact me and let me know they have reopened the file on my foreclosure and they are investigating my forecloser

    How about a class action lawsuit in Missouri against Citi Mortgage , they are doing the same thing here. We were in modification process for a year and a half. Everything were were told was misrepresentation of one form or another. The bailout money sure did not trickle down to help us. I know it stopped in the pockets of the executives of Citi Mortgage. Any class action lawsuits out there? we’d like to be included! This is just not right. The fleecing of the working class.

    Is there a class action suit going on in Florida?, because I have hard copy evidence of forgery and fraud, done by Citimortage. I would like to be included.

    Would someone PLEASE implement a Class Action Lawsuit against CitiMortgage in the State of Florida. I would jump on board. We paid CitiMortgage over $11,157.97 for ONE missed mortgage payment due to Hurrican Ivan on top of our mortgage payments. They did not record all the money they recieved from us and had the nerve to say we did not pay that amount. It took filling a complaint through the AG Office before they admitted they recieved all our money. Then they said we did not pay enough and are trying to get an additional $15,000.00 out of us. (In forty three months, my husband and I have paid CitiMortgage over $40,000.00 in cash. We have a $60,000.00 mortgage that no principal has come off.) We have been paying on our house for 18 years. They are killing us………….

      Howdy Folks, Update on our CitiMort/ case. We settled November 01, 2013. Terms: we pay $31,000.00 within 48 months, zero interest, they fix our credit, no def/,judgements or leins, no early payoff penalties, they have to pay their legal fees, mortgage will state “Paid in Full-Satisfied and they dismiss their case and correctly update property records. Folks, don’t give up! We hired our first attorney 8 years to the date of our settlement. Feeling very blessed. Been a hard fight. Thank you Foreclosure Fraud!

      Oh my, this happened to us too! We were making payment during a trial period and nowhere does it show in our records where that money went. When I questioned the bank as to why these funds weren’t applied to my mortgage, they could not give me a straight answer.

      This is so true! I have been in the banking / mortgage / real estate industry since I was 18 years old….I’m over 60 now. This is the truth for sure…..if we get rid of the Cartel…LOL, the entire banking industry will collapse! This is noting new! How do we fight it…..my suggestion is to allow the banking industry to collapse and create a way to recover. Barter trade is on the table.
