“My registry will not be a knowing participant in this fraud against homeowners,” O’Brien said in a statement. “From today forward, lenders be on notice, the Southern Essex District Registry of Deeds will not record robo-signed documents.”

Robo-signed documents rejected following 60 Minutes show featuring Palm Beach County homeowner
by Kim Miller
Massachusetts Register of Deeds John O’Brien is rejecting foreclosure documents signed by known robo-signers.
O’Brien is one of a handful of officials nationwide who began pulling court documents following a 60 Minutes story on foreclosure fraud that featured a Palm Beach County homeowner.
On Tuesday, Obrien said he rejected two robo-signed documents submitted to his registry for recording and plans to continue doing so.

You would think that several of these clerks getting it would be enough to swing the rest of them…..not so.We tryed it where we live and the head clerk wrote back and said they are following our state AG’s lead.Wow where to straight to hell perhaps?
Its good that O’brien is rejecting documents with known robo-signers signatures on them, however he needs to send those copies over to the States Attorneys office and PROSECUTE whoever submitted those documents for filing fraudulent docs.
If a private citizen where to file those fraudulent doc’s, you can bet your a$$ they would be charged and arrested before the sun sets.
O’Brien and Thigpen are wonderful, honest people. This battle is not over yet.
It is sad that it needs to be so but it is encouraging that of all the corrupt and illegal acts going on even in our courts that someone has decided to refuse to participate.
However, considering the way things operate today and the deterioration of the moral principles which used to guide us, I fully expect to see this honorable man’s refusal to file these documents and thus give them credibility to be challenged. If recent history is any indicator this Register of Deeds Office will be ordered to accept the documents or those refusing will be unemployed and possibly facing legal sanctions.
THAT is the way the world works today.
I agree with you. This country set up the laws to protect everyone and someone will always feel they do don’t have to follow the laws set forth. We see banks, attorneys, law enforcement, judges outright ignoring these laws. And some people feel that that behavior is acceptable all because that homeowner supposedly did not pay their mortgage. People ARE going to loose their jobs because they are following the law. If every Register of Deeds in every county of every state stood up and sounded off to this illegal activity, maybe then and only then would this practice of robo-signing be stopped with regards to land records. In a perfect world.
And if the other Registrars in MA followed course we might be better off. yet we only have 3 standing their ground. Whats it gonna take for the others to realize the FRAUD in their documents?
