Government to Inspect Delinquent Homes
If you happen to see a contractor walking around your house, taking pictures, don’t panic. It’s just your lender “inspecting” your property.
According to new rules announced by Fannie Mae this week, mortgage servicers will be required to “order” a “property inspection” no later than 45 days after a homeowner misses a mortgage payment. “The servicer must continue to obtain property inspections every 30 days thereafter” until the delinquency is resolved.
If the servicer determines that the property is abandoned “the servicer must perform an interior inspection upon confirmation of abandonment,” according to Fannie’s guidelines, which go into effect on Sept.1
Sounds pretty comforting, doesn’t it?
Well how about this…
The new policy is an extra effort to try to protect Fannie’s investment in these assets. But has Fannie heard of the widely reported stories of banks breaking into people’s homes to “inspect” and “secure” them, claiming the homes are vacant when they are not?
For example, there is the story Nancy Jacobini in Orlando. Late last year she called 911, desperately asking for help as a man tried to break into her house. After police arrived, she learned that the man was a contractor who wanted to “secure” her home on behalf of her lender, Chase. The inspector said he thought the house was vacant. A Chase spokeswoman has told me this was an isolated mistake and that they have apologized to Jacobini.
You all remember Nancy Jacobini right?

Speaking of mistakes, you might want to know that some of these lender/servicer break-in cases that have been reported over the last two years involved homeowners who were current on their mortgages.
Too many to list on this one. But, here is the latest report…
Here is the real problem…
First, it’s important to understand how this works and the number of people involved in this process. Servicers don’t hire and train their own Jack Booted Thugs inspectors. They hire a Jack Booted Thug property management company, which then hires more Jack Booted Thugs contractors to go out and do the “inspections.”
The question is how does the servicer’s Jack Booted Thug determine whether a home is vacant before securing it? Do they peek through your window? Do they assume your home is vacant if you haven’t mowed your grass and happen to be on vacation?
A Fannie spokeswoman says the process involves various steps and it includes checking to see if utilities are on, if there are people in the house and if there is furniture in the property.
But how do you know if there is furniture in the property before you enter the house?
The spokeswoman declined further comment beyond what is explained in the guidelines.
Yea, how do they know if there is furniture (or people) in the property without creeping around and peeping in your windows while you are living in YOUR home?

No need to shoot anyone. If you live in a gated community, ask the board if you can post notices in the guard station to hold trespassors. Have the guaard call you immediately if ones appears.
Then, do a citizens’ arrest and call the police or sheriff’s office to come get the trespassor(s.) If Fannie and the banks cannot prove they own the home, they shouldn’t be on your property without permission.
The board will probablly approve–they’ll have several homes already in foreclosure by now. Hordes of bank snoops are not conducive to other owners’ selling their property. It gives the imprssion the whole neighborhood is going under!
I’ve also read about locksmiths and sheriff’s deputies shot through homeowners’ doors in Florida– it’s a dangerous business.There’s a rumor that the widow of a homeowner killed “in battle” is now suing for wrongful death, as well as fighting foreclosure. Her name is on the deed as well.
KATHLEEN….Not everyone lives in a gated community… a whole lot of homes don’t have or want an association telling them what they can and can’t do. That is a right we choose….and even if a gate guard stopped anyone from entering the community…just what would you call the police for…they have not entered..so that part is not trespassing. Another thing you don’t seem to understand….in most states or area’s the police nor the sheriff dept. will not even come out with just a call that someone is at the gate wanting to come to your home. The banks are NOT following the laws of this land….they made their own laws…they have broken all laws already and continue to follow no laws. We are not here to just protect the gated communities…so let’s get over that…we are here for everyone regardless where you live…..even for those who rent. Gated communities have no more protection and a single home outside of a gate. I live in Florida…so we are well aware of all that goes on…moreso than alot of other states…we live in a corrupt state and fraud is the name of the game here….not oranges…FRAUD. Also….anyone who breaks into your home…through a trail of scums working for the fraud banksters…also have concealed guns on them…so it has come down to who has the fastest trigger finger…..wake up Kathleen….it is way past your thinking………….. .
The only gate homeowners fighting fraudclosure are living behind is the corrupt court system because they are not following the rule of law and doing their job. The only gated communities I know of in Ill, I don’t know about Fla. are the Million + homes and those gated communities are where the criminal banksters, the corrupt politicians, the corrupt judges and the corrupt lawyers dwell with one another. They need to lock their gates to keep all of us from coming in there with torches and ropes to hang them with.

Just yesterday there was a “property inspector” at the 2 1/2 year old foreclosure next door.
New White truck, nicely dressed professional type man with camera, looked at electric meter, peeked in windows-took him about 10 minutes. He did not bother to take a walk to the backyard to get photos of trees downed by storm & weeds 6-7 feet tall or of the Heat/AC Unit parts left hanging by thieves from the outside wall of this house.
This man did not take photos of wide open windows & doors-literally an OPEN HO– USE.
Last week there was a a different truck, stopped in street taking photos of my property, as I approached he sped off. There have been many different “characters” stopping by to take photos and I’m sure it is not because I have
a beautiful landscape and tomatoe garden. This is INVASION of PRIVACY. It makes you feel insecure & suspicious. It is causing me EMOTIONAL HARM
Someone keeps removing my No Tresspassing Signs ! I’m sick of paying for them and putting them up.
The County Sheriff (here several times) gave me permission as he watched me post NO TRESSPASSING signs on my house & next door. I was told the property must be posted if they are expected to arrest anyone.
The County Code Enforcement & Property Appraiser Offices told me to stop mowing and that I have been tresspassing next door !!!!!!!!!!!!
yet no agency or bank or servicer is watching over what is left of this property.
My dog died, so I will get some help from my Uncle Beretta.
He’s small but very powerful & with me at all times.
I’m disabled and different “Castle Law” applies to me.
All they have to do is call me or my Attorney-listed on Court Records.
Even if your home is LISTED FOR SALE at least a realtor would give ya a phone call or make an appointment for Appraisal or showing…………….if someone is expected I would invite them in….if you are not expected then prepare

They get away with this because they know they can. They know that law enforecement–I wonder why I even say enforcement that anymore–will do nothing. The law enforcement they use is to get the deadbeat homeowner out of the house. The banks could care less about the house, they want the DEED to the property.

My personal case involves origination fraud. The original docs I signed at my closing were not the same docs submitted for securing the loan. The attorney accidentally sent me the docs Countrywide used for the loan origination. I now have both copies. The most bizarre part of the original docs is the REO statement. It showed me 100% owning a property that doesn’t, and never has, existed. They even threw a bogus value on the non-existent property.
This is the problem with how loans were originated. Contrary to popular opinion, these loans were originated “over the phone”, and the borrowers do not see what is actually being submitted. Not only is this securing a loan with bogus info, it is securities fraud when it is sold and pooled. BTW…I notified the SEC about this. They don’t really care.
Here we go again another way of property rights violations, even if the homeowner is in default the home is still in his name, estrange people sniffing around the home is trespassing or breaking and entry and should be jailed !
My house was broken in to on three or four occasions before the actual foreclosure took place. The police in GA refused to even take the police report that the insurance company required so my homeowner’s insurance would pay me for the stolen items.
I wonder if this is a problem in in Kennesaw, GA, where every homeowner is REQUIRED by LAW to own a gun! I now own my house free and clear…but just in case, I’m putting up “This House Protected by Smith & Wesson” stickers on the door and every window! Does anyone know if it is a crime in GA, FL or TN to “booby-trap” your home while you are away? I’m thinking something along the lines of the ink-packs the banks put in with the money in robberies.

The loan is still active in MERS according to MERS DATABASE and PHH and Fannie Mae are trying to join me to fraudclose on MERS. On my public recordings the mortgage was released form MERS right after the 07 refi. and on title they call themselves AMCORE, N.A. MERS. LMAO. They are an IDIOCRACY!!!!
While we were in foreclosure we filed BK. Our attorney said no one could come onto the property. Twice that we were aware of, a man driving a silver jaguar, wearing a suit and tie drove into our yard and took pictures from his car. He saw us as we were standing outside. As we started to walk towards him, he backed out very fast. Wonder if he was scared of us?

In 1988, and for four years I had a company in the San Bernardino, Ca area doing the job known as LAPS-loan and property service.for HUD’s lenders. We checked the property and were the ones who recommended that the house be foreclosed upon-if the home was vacated. We diligently made sure there was no one at home-or living there. Then we broke into homes [I learned to go into most any home within a minute or so], changed the locks to a Master Lock number of A112 and secured the property for HUD. All the RE Brokers had A112 keys so they could evaluate the property after we cleaned it up. We did hundreds of homes-and never once had a problem with the home owners.
The whole problem lays in the selection of the contractors who did the work for ] major contractors whole dealt with HUD in sections of the nation. My contact was Ralph something out of Salt Lake City. Others were Three Brothers out of Detroit. Our cleaning up of the home we called “gold digging” because of the valuable things we had to store for homeowners who almost never picked up the goods from the storage area. You tell that story like it was something to be proud of, breaking into houses like some third rate burglar and packing up people’s things before the house forecloses legally. I suppose you confiscated what people left for the most part in your “gold digging” activity.
Illegal entry is more prevalent than one imagines. I know of two breakins that occurred BEFORE the actual foreclosure sale took place. That is illegal just like what you were doing was illegal. If the bank has not foreclosed, and there is no eviction order issued or posted, people like you have no legal right to enter. Most states have an eviction period requirement even after foreclosure takes place. I agree we are close to the old Simon Legree cartoons of the past where people’s homes are being confiscated illegally under fraudulent circumstances but will lenders/banks continue to turn their backs on law?

Well Grampa Jack, how did you feel knowing you were kicking out children? You said you did this in 1988 for 4 years, is that when you got out of the business? What did you do to make sure the house was abandoned? Well, they do things differently now, they just go into houses whether people live there or not, load up people’s things and take them to the dump. I call that theft. When the people come home, they found themselves out into the street, and their property is gone. And some of these people are CURRENT on their payments. This is an industry out of control and it needs to be stopped. People have rights and they have been violated.
And I want to add that you are not my Grandpa because both of my grandfathers (May they rest in Peace) would never ever think about doing what you did. I know for sure my one grandfather would be shaking his head in shame for what you did. You see he came here from Poland as a young child to escape what was happening there in the early 1900’s. I heard his stories and saw the pain in his face as he recalled memories that he had. And he would be HORRIFIED to see what is happening here to the land he and his parents thought was the land of freedom from oppression and evil. What happened in Europe way back then is happening here now. Everyone should be afraid, very afraid.

Two days prior to due date, locked out, in process of moving out/needed to complete painting trim that was all, was told $1,000 at time of lock out, given nothing, was walked out of home of 12 yrs., forced to move back into pricer home pending short sale, Loan sold to federal housing, they foreclose and at auction changes hands with fannie mae. So everyone is doing their jobs? This was illegal, no recoarse, civil matter, no legal counsel. Senior, fixed income, now waiting for close of second home, will live in car, beats being stupid and continuing with their game of modification???Liars and they now even have Hud working with them.
