Former foreclosure king in trouble with Florida Bar

The Florida Supreme Court today released a complaint filed by the Florida Bar against attorney David J. Stern, whose Plantation-based law firm was once the largest company in the state representing banks in foreclosure cases.

The complaint stems from a Sun Trust foreclosure action handled by Stern’s firm in the Fifth District Court of Appeal.

Details are still forthcoming, but the court entered an order in February to show cause requiring Stern to explain why sanction s should not be entered against him for his failure to timely file certain documents in accordance with a prior court order.

From the complaint…

On or about February 16, 2011, the Court entered an Order to Show Cause requiring respondent to show cause why sanctions should not be entered against him for his failure to timely file certain documents in accordance with a prior Order of the Court. A true and correct copy of the February 16, 2011 Order is attached hereto and incorporated herein by reference as The Florida Bar’s Exhibit A.

Respondent failed to produce the documents and has otherwise failed to respond.

On or about March 14, 2011, the Court referred this matter to The Florida Bar for “investigation and consideration of appropriate disciplinary action for failing to comply with the February 16, 2011 Order.” A true and correct copy of the March 14, 2011 Order is attached hereto and incorporated herein by reference as The Florida Bar’s Exhibit B.

By the conduct set forth above, respondent violated the following R. Regulating Fla. Bar:

A. Rule 3-4.2 [Violation of the Rules of Professional Conduct as adopted by the rules governing The Florida Bar is a cause for discipline.];
B. Rule 4-3.4(c) [A lawyer shall not knowingly disobey an obligation under the rules of a tribunal except for an open refusal based on an assertion that no valid obligation exists.]; and C. Rule 4-8.4(a) [A lawyer shall not violate or attempt to violate the Rules of Professional Conduct, knowingly assist or induce another to do so, or do so through the acts of another.].

WHEREFORE, The Florida Bar respectfully requests this Court enter an Order appropriately disciplining the respondent in accordance with the applicable provisions of the Rules Regulating The Florida Bar as amended.

    Disciplining?!?!? How much discipline does little Davey need? Are we in GRADE SCHOOL??? What a disgrace the FLORIDUH BAR is!!!

    When can we “go after” Fannie Mae? I mean, aren’t they responsible for hiring these goons nationwide? (with our tax dollars incidently)
    Stern just happens to stand out as being the King of Attrition, in other states, other firms are pulling crap left and right (felonies) and the State Bar simply yawns. Dick Durbin famously stated that “Banks own this place” before cramdown was destroyed, how much else do you suppose Banks own?

    Looks like cover to continue harassing defense attorneys to me. Stern will wind up being Attorney General.

      going to get their asses kicked?

      i want them to serve jail terms, pay fines and pay full restitution to their victims.

        There is a very big distinction between “negligent representation” and “fraudulent representation”.

        They knew what they were doing…all of them…the Bar, the courts, the legislature, all of them. Sorry to be jaundiced but it seems to me that this amazing discovery by the Bar is the equivalent of throwing a pie in their own faces.

        It’s just a game for now. When it’s over…and we’re getting close…it won’t be pretty. And it will be all their fault. They hear the rumbling and it is getting louder…we are waking from our slumber.

    we have a husband and wife f/c lawyers in NY state just like stern. they aren’t posing with glass blown candlesticks, they are posing and smiling in their vineyard. rosicki & rosicki . check them out.

    i hope AG sneiderman takes them down.

    Wow, this is surprising that the FL Bar even cares about Stern’s crimes. The FL Bar and FL government have shown no care for enforcing the law in the past against the criminal banks. I’m impressed.

    Wow! Perhaps the Bar is finally beginning to understand how their reputation has been tainted. The door is starting to open.

      The Bar expects you to celebrate, but there is no reason to celebrate. The Bar regulators were forced to take action by the 5th DCA. Otherwise, they would have continued to look the other way.

      Notice that the Bar regulators did not mention any violations related to the crimes of filing fraudulent affidavits and assignments in order to steal homes. I expect that the Bar has received thousands of complaints about Stern, but since the Bar says that these complaints are secret, it can pretend that this is the only one which they have received.

      What is worse: filing tens of thousands of fraudulent affidavits and fraudulent assignments to steal the homes of tens of thousands of families, or failing to comply with a court order requiring him to file a mediation questionnaire?

      Like the bank regulators and the prosecutors, the Bar regulators take cash to cover up crimes. The Bar will also probably throw this case so that Stern doesn’t even get the reprimand that he should get for the very minor violation that he is charged with.

      The criminals who run the Bar and Stern are laughing at those who are celebrating this insignificant complaint. They think that everyone is a fool who will be fooled by any little complaint which they can use to say that they are protecting the integrity of the legal profession.

      Next, the Bar will pretend that it is investigating foreclosure mills. Oh, wait, the Bar already did that, but it hasn’t found anything wrong, right?

        You are so right. My admiration, respect, and trust in lawyers is ZERO.
        Every time I look at a judge I wonder if he/she is on the take.

        Question: what do you call 1000 lawyers on the bottom of the ocean?
        Answer: a good start!

    • Alice…read Capt. Jack’s comment…..the ground is starting to shake…and many doors will open. The Bar has aided the criminal lawyers and went after the good lawyers….yes, I would say their reputation has been tainted…they certainly do not deserve any respect from the citizens of Florida…they showed their true colors ever since this foreclosure crap started. Corrupt is corrupt no matter how it is spit out.
