More Bondi Bullshit | Statement by Carlos Muniz, Deputy Attorney General/Chief of Staff RE the Firing of June Clarkson and Theresa Edwards

Look, if you are going to make up accusations on why you fired the two top fraudclosure investigators in the country, have your lies ready before you do it. It has been two months since June and Theresa were fired, over a week that the story went national, and now you come out with this rhetoric?

I happen to personally know these fine women and in my opinion the below statement is a flat out lie spun to deflect the negative attention…

As Matt Weidner puts it…

After a week of coverage, Florida’s Attorney General is finally setting the record straight.  The attorneys working in her office who were investigating foreclosure fraud were not doing their jobs properly.  And not to worry Floridians, because Bondi now has 8 (Count em, Eight!) attorneys investigating all the wrongdoing.  Now I’m sure that these 8 new investigators didn’t need to get any information from Clarkson and Edwards and I’m sure that just sending both of them packing unceremoniously was the correct thing to do….after all, they were performing poorly.

And importantly, Florida’s Attorney General is ABSOLUTELY COMMITTED TO FIGHTING FORECLOSURE FRAUD. In fact, Florida’s AG has not just added resources to aid in these investigations, no our AG Pam Bondi has, “dramatically increased the investigator resources devoted to this issue.”

And because there are so many precious state resources devoted to this issue, I expect that there will be press conferences and high profile announcements any day.  For the first six months Florida’s Governor and Attorney General have been pounding on the Pill Mills every day.  Press Conferences, Photo Ops, Cheerleaders, Marching Bands.  Now that they are apparently putting this same passion and focus and passion on the foreclosure problems, I’m sure we can all expect  similar results and attention.

I’m sure you can sense a tad bit of sarcasm from Matt’s post. I wouldn’t hold my breath…

Statement by Carlos Muniz, Deputy Attorney General/Chief of Staff

At the end of May, with my approval, June Clarkson’s and Theresa Edwards’ supervisor met with them and gave them the option either to resign or be fired.  The reason was entirely related to the attorneys’ job performance.

As reflected in an April review of our agency’s South Florida Economic Crimes Bureau, the attorneys’ shortcomings included problems with: “proper identification and analysis of legal issues;” “judgment in discussing matters related to pending investigations with third parties;” and “professionalism to opposing counsel.”  Clarkson and Edwards were fully aware of these deficiencies, since their division director had met with them three times over a several-month period to discuss their performance and to demand improvement.  It was only out of basic professional courtesy that I authorized giving Clarkson and Edwards the option to resign rather than be fired outright; their performance was unacceptable, but they had not engaged in deliberate misconduct.

It had been the agency’s preference not to publicly criticize Clarkson’s and Edwards’s performance or to discuss the circumstances surrounding their departure, because doing so would have been inconsistent with the decision to give the attorneys the option to resign.  However, for reasons known only to them, the attorneys have baselessly suggested that they were the victims of “politics” and that our agency is uninterested in pursuing foreclosure-related wrongdoing.  Their reaction is unfortunate, because nothing could be farther from the truth.  Clarkson and Edwards are no longer with the agency because of their poor performance and their failure to improve after multiple warnings.  If anything, it would have been “political” and irresponsible for the agency to retain low-performing attorneys solely out of a fear that their involvement in high-profile investigations would cause an otherwise mundane personnel decision to be sensationalized.

Attorney General Bondi has made protecting consumers and fighting fraud a top priority of her administration.  One of her first acts as attorney general was to personally recruit seasoned and respected prosecutor Richard Lawson to head the agency’s Economic Crimes division, ensuring that the unit would be led by someone with the commitment and the skill to hold wrongdoers accountable.  Under Attorney General Bondi’s leadership and direction, our agency has sought aggressively to protect consumers from foreclosure-related misconduct, with the result that we have ongoing investigations of nine foreclosure law firms and businesses.  We have increased from two to eight the number of attorneys investigating so-called “foreclosure mills,” and we have dramatically increased the investigator resources devoted to this issue.

All Floridians can have confidence that the Bondi Administration hires and evaluates agency attorneys on the basis of merit, professionalism, and ethics, and that we strive always to find the best possible attorneys to serve the people of our state.

That’s all they got, and it doesn’t even hold water… They have been scrambling to come up with something since the story broke. Too bad it will backfire beyond their imagination…

Some quotes from the Palm Beach post on the matter…

In his statement Thursday, Muniz refers to an April 28 review of the South Florida bureau and Chief Assistant Attorney General Robert Julian that lists staff shortcomings, including “proper identification and analysis of legal issues” and “professionalism to opposing counsel.”

“Hopefully improvement will be made in these areas in the future,” the review concluded.

It does not mention Edwards or Clarkson by name.

No it does not…

Just seven days earlier, in an interim evaluation of Edwards, Julian praised her work, saying it has been “instrumental in triggering a nationwide review” of foreclosure practices.

“I cannot overstate the degree to which I respect Ms. Edwards and her work with this unit,” Julian wrote.

Well, isn’t that nice…

Both Edwards and Clarkson also received high marks in evaluations conducted in the fall.

Clarkson was given “above expectation” or “exceptional” rankings in 14 of 15 categories.

Edwards received “above expectation” or “exceptional” rankings in all 15 categories.

“The shortcomings outlined are hard to understand when you put them beside the evaluations of 2010,” Edwards said Thursday. “I dispute the version of events released by the attorney general’s office.”

That doesn’t sound like  problems with: “proper identification and analysis of legal issues” and “professionalism to opposing counsel.”

But…

The investigations have faced setbacks. The Boca Raton-based law firm of Shapiro & Fishman won a ruling in the 4th District Court of Appeal in April to quash a subpoena it was issued last year. The state is not challenging the decision. A similar subpoena to the Law Offices of David J. Stern was upheld in Broward County Circuit Court, but has been appealed to the 4th District Court of Appeal.

Muniz said Thursday the resignations had nothing to do with politics.

“The attorneys have baselessly suggested that they were the victims of ‘politics’ and that our agency is uninterested in pursuing foreclosure-related wrongdoing,” Muniz said. “Their reaction is unfortunate because nothing could be further from the truth.”

Time to put on the boots.

I can see why the fired investigators are confused though…

“It seems strange,” Edwards said, “that they would remove the two attorneys who knew the most about the background and had gotten the farthest in the investigations without any opportunity to provide transition notes.”

Yea, exactly…

So, poor performance or something else?

I’m going with the latter…

I think it may be time to let Bondi know how you feel about this…

    Here’s some more BS. And I would like to know if 4closurefraud or hamlet have ever commented on or addressed this part of the fraud.

    1) is the mortgage loan a “Bilateral” or a “Unilateral” contract? If it is Bilateral then where is the lenders signature?
    2) Did the lender lend you actual “money” or “credit”- and if it was credit who created it? Did your signature create it or did the lenders?
    3)If they did loan you money, which as I understand it, banks/lenders cannot put their shareholders or customers assets at risk. So is it just conventional wisdom/belief/misrepresentation that you went in to get a loan for your dream house and slice of the American Pie thinking that they were taking your promissory NOTE-walking it into their vault to deposit it for safe keeping-and while they were in the vault they withdrew FRN’s (another debt instrument-key word Note) or “real money” and gave that to you(?) If there was no even exchange and if this is a Bilateral contract then where is the true consideration-where is the liability on the lender/banks side of the contract as well as their bookkeeping entries- especially regarding the Fractional reserve system, Modern Money Mechanics and GAAP.
    4) If (and this may be out on the limb for some of you) If, the PROMISSORY NOTE i.e. Mortgage Note and credit- that was created/monetized (key word) by your signature and they- without full disclosure to you, Securtized it / Converted it to a stock/bond certificate and then put it out on ‘The Market’ for investors to invest on an instrument created by you via REMIC and SPA- where is your Net Proceeds regarding the stock instrument your signature created?
    5) Would you have signed on the dotted line if you were given full disclosure of their studied concealment to do just that? Would you have signed on the dotted line if they disclosed that it was your signature that monetized that instrument and that they were going to charge you interest on “credit” that you created?

    Here’s a few more questions on fraudclosure and the whole stinking pile of crap that has been created to fleece us all of our life, liberty, happiness, right to own property and right to due process.
    Why would a judge or court EVER rule in your favor if they have pensions or investments in Mortgage Backed Securities? Seems like a bit of a conflict of interest there. What do you think?
    If my ramblings have exhausted you I apologize but if they have whet your whistle to look for these answers or to even challenge them – then I say do your own due diligence and come back here and add to this post.
    Researching, turning over rocks, peeling back the onion skin, falling down the rabbit hole, questioning the system – and- NOT burying our heads in the sand- is one of the major ways we are all going to get out of this mess.

      What they did was — USE US as collateral for their Ponzi Scheme. THE “LENDER” WAS ONLY A SPONSOR, NOT AN ACTUAL LENDER. All they needed was a signature. They never lent any money to us. THE SPONSOR sells the loan pools to the DEPOSITOR who also prefunds the loans by issuing securities WHO ISSUED THE SECURITIES WAS I THINK THE U.S. TREASURY WHEN THE DEPOSITOR HANDED IN THE PAID NOTE AND MORTGAGE TO RELEASE OUR DEED TO US AND PAID THE SPONSOR IN THE FORM OF BONDS, THAN THE TREASURY sold securities to the bonds(backed by unsecured notes) to WALL STREET and the FED sold them to investors??? The fact that they never perfected the collateral lien at origination proves our homes are paid for. THEY NEEDED COLLATERAL, OUR SIGNATURES. What they sold to investors was the securities to the bonds(THE UNSECURED NOTES),the money flow on a speculation of our ability to pay. THEY DID NOT SELL THE MORTGAGE WITH THE NOTES AND THEY SOLD THE SAME UNSECURED NOTES MULTIPLE TIMES. Investors were also deceived into thinking the quality of the loans was better but they knew there was a risk. The investors had a ball for a while. BOTTOM LINE: It was a GIANT MORTGAGE FRAUD PONZI SCHEME SWINDLE AND HEIST OF THE AMERICAN PEOPLE.

        The Bondholders/Sponsors don’t hold anything they are a creditor to the trust. The Treasury sold the securities to the bonds to WALL STREET and the FED who sold only an investment in a money flow that dried up when the shit loans the Sponsor GSE’s backed went sour. The IMF is the biggest shareholder in the GSE’s. That means the IMF invested in those now worthless bonds that Fannie and Freddie hold as well as the pretender lenders like Chase, Bofa and Wells Fargo who are also owned by the IMF/WORLD BANK…..THE NEW WORLD ORDER. It looks like Wall Street/THE BANKSTERS and the Fed dumped all of their UNSECURED NOTES into a Global Trust.   4. Am I understanding this correct…..Bondi fires 2 investigator lawyers and hires 8 to replace them? If so…when times are bad and kids are taking alot of budget cuts….what gives with this AG’s office? Were the first 2 lawyers doing the work of 8….???? If that is correct and they were given a choice ‘ resign or we will fire you ‘…seems to be a law suit coming in the future….I will be honest…I don’t believe NOTHING Bondi say’s or anyone else in that office that blows kisses to her…..it appears that office needs to be emptied out and done over…not all are to blame that work there…it sounds like a cozy circle of a few….but one bad apple in a bushel of good apples make the rest all rot……so let’s get the rotten one out.

    I like the article I read yesterday http://www.wusf.usf.edu/news/2011/07/21/bondi_poor_performance_not_politics_led_to_ouster_of_robo-signing_investigators which states that according to campaign records, a direct campaign contribution of $6500 came from *****601 Riverside Avenue Jacksonville Florida***** which just happens to be the address of Lender Processing Services, and they also donated another $78,000 to the Republican Party of Florida which was itself a major funder of Bondi’s campaign.
    No Sir, no foul play there…..

    They think we’re all STUPID!!! I continually post on Bondi’s facebook page….

    This is total BS!

    Last week I called Bondi’s office to complain about the firings and I was told that the AG’s office was no longer investigating Mortgage Fraud. According to the AG’s office, mortgage fraud including counterfeit Notes should be reported to the Office of Comptroller of the Currency or the FBI.

    Floridians call the AG’s office to raise hell and call your local State Senator and Representative to demand an investigation of Bondi.

    Well, she can start by giving the names of the 8 new lawyers. And she can begin transparency and allow the media and public to visit and talk to these 8 new investigators. Where are their offices? How can one contact them? What is their email address? What is their experience in foreclosure fraud? Have they ever worked for a foreclosure lawyer on the plaintiff side? Have they ever participated in any of the robo conduct we have been screaming about now for five years? Lots of questions need to come up. I do not see Pam Bondi as anything but a Republican AG who does not care about the people. That is how Republicans are. She and Scott make a twin team of stooges. Throw her down Jehu. Throw her down.

        Sorry guys but none of this will work…filing complaints, making phone calls. Don’t you get it? They don’t give a hoot, crap, sh** about you. The only real means of communication is mass protest by the masses! They hold on to the premise that we will never combine….never come together as one. Elections are bought and paid for and they (the politicians) are coached on how to be the wolf in sheep’s clothing because as “sheep” we will recognize one of our own but fail to see the EVIL of this world. Set a date, set a time and come together all at once at the doorsteps of your local governments. Let them know we are coming, sound the horns. They are not reading these blogs and we are only satisfying our own inner hatred by sharing it with others but it stops there. 500 or 1000 peple on the lawn of the local government, blocking traffic, making our voices heard…sing The Star Spangled Banner or God Bless America,,,singing is not a crime! Your words, letters, blogs are falling on deaf ears!
