Mass. AG Coakley launches probe of foreclosure mess

Massachusetts Attorney General Martha Coakley has opened a probe into whether banks violated state property-recording laws during the housing boom — and broke foreclosure rules during the resulting housing bust.

“We are currently investigating creditor misconduct in connection with unlawful foreclosures, including failure to establish the right to start a foreclosure as well as filing false or misleading documents with registries in the Commonwealth,” Coakley wrote today in a letter to state registers of deeds.

The attorney general said her probe will specifically look at whether use of the Mortgage Electronic Registration Systems — a private network that lenders use to record paperwork when they trade mortgages among themselves — violates state property-records laws.

“We have focused particularly on creditors’ reliance on MERS and whether MERS conforms to the requirements of Massachusetts law, in the context of foreclosures and otherwise,” Coakley wrote.

Some experts claim mortgages transferred via the MERS system but not recorded with local registries of deeds are invalid, “clouding” land titles on thousands of homes. Homeowners with clouded titles could find their properties impossible to sell or refinance without going to court to clean up any problems.

  2. Remember they are unscecured debt now ! However even a written signed promissory note has a statute of limitations for collection 5-7 years for most states. and unsecured debt is around 3 years for most states. look up Adverse possession in your states. Washington law is seven years on consecutive paid taxes and ten of possession.

I have sent a stack to this attorney general and the Washington State attorney General and Bondi, a lot of good that will do, however if you send it to her in Florida, maybe she get the picture thousands are watching and know the truth.     I have been checking my MIN with MERS at mersinc.org. It’s really funny how they think they can be slick.My status a few months back was active with one lender and servicer,and today it’s with another.Unbelievable! Good thing I had made copies of all the FRAUD that pertains to my situation.I have lots of proof to bring to my court hearing in September.I’m gonna take the s.o.b’s down!

    A few more AGs on board will bust the MERS deception open. MERS is a database set up to circumvent the law throughout the US while simultaneously not accepting responsibility for valid documentation. MERS has no legal standing and the sooner this FACT is established the better we will all be. Then you will see serious efforts to modify loans with appropriate documentation or risk the loss of the collateral property. Most foreclosures in non-judicial states rely on this slam scam method of property confiscation without proper chain of title or legal standing in the courts. Not seriously challenged up to this point, few attorneys have the expertise to comprehend what the banks did and are doing. A shroud of secrecy will not permit discovery of the information needed to follow the chain or fraud. There was an attitude of “make us” and “you can’t” when it came to disclosure. That is about to change! You people in MASS write and encourage, hold up her arms for this fight!
