Mortgage paperwork mess: the next housing shock?
(CBS News) If there was a question about whether we’re headed for a second housing shock, that was settled last week with news that home prices have fallen a sixth consecutive month. Values are nearly back to levels of the Great Recession. One thing weighing on the economy is the huge number of foreclosed houses.
Many are stuck on the market for a reason you wouldn’t expect: banks can’t find the ownership documents.
It’s bizarre but, it turns out, Wall Street cut corners when it created those mortgage-backed investments that triggered the financial collapse. Now that banks want to evict people, they’re unwinding these exotic investments to find, that often, the legal documents behind the mortgages aren’t there. Caught in a jam of their own making, some companies appear to be resorting to forgery and phony paperwork to throw people – down on their luck – out of their homes.

Hi, Dan,
I approach the reairing this Sunday of the foreclosure fraud episode on 60 Minutes with mixed feelings.
Before the initial showing, I would have asked “How can we get judges, prosecutors and legislators to watch this?”
Now, I am asking, “How can we get judges, prosecutors and legislators to care about this?” Judges have watched the episode and have said “I don’t care that the notary wrote her name upside-down.” Others said,
“I can’t let a TV show into evidence.”
I was floored by this. Why would so many people be so determined to trivialize these crimes by banks?
I was contacted by several thousand people after the show – many were losing their court cases to documents “signed” by Linda Green. Lender Processing Services refused to step forward and disclose to courts that these documents were fraudulent; the mortgage servicing companies continued to press as many foreclosures as possible using these documents or similarly forged and fraudulent documents.
By far the most disturbing development was the firing of the two Florida Assistant Attorney Generals, June Clarkson and Theresa Edwards, who were leading the investigation of LPS. One of the reasons was
that they had been too aggressive with the lawyers representing LPS. Then one of the highest ranking members of the Attorney General’s office joined LPS as a Senior VP of government affairs. Then the press began reporting
about campaign contributions made by LPS and LPS officers to the Florida Attorney General.
No matter how egregious and well-documented the wrongs, there are no consequences for the banks.
By far, my overwhelming feeling four months later is anger – mixed with renewed determination to speak the truth. I am very disturbed by the power of banks. Before I was somewhat aware that banks had gained
tremendous power and influence. Now, I am aware almost every moment of every day that money controls our politics and banks control our money.
The most encouraging development has been the reaction of county recorders. I flew to North Carolina to meet Guilford County Recorder Jeff Thigpen. Jeff is not the sort of individual who watches TV and says,
“Someone should do something about that.” Jeff and his co-workers really went to work immediately and have been working ever since to expose the corruption of our land records nationwide. In Massachusetts, John O’Brien
even commissioned a study and has spoken out about the massive problem caused by MERS and corrupt mortgage servicers. In Michigan, it was Curtis Hertel, Jr. who dared to speak the truth.
In Florida, almost nothing has changed. The state attorney and the clerk of the court here have NOT accepted my request to meet with them. The Florida Attorney General’s office may be hard at work investigating my complaints,
but if so they sure have not contacted me. Once June & Theresa were removed, all communication ceased.
Deutsche Bank and its lawyers have become much more aggressive in my own case, even adding my son as a defendant (though we were able to get that dismissed).
If the extent of this fraud is ever exposed and addressed, it will be because people like these country recorders and bulldog legislators like Elijah Cummings of Maryland were not intimidated by the banks and their service companies.
My regret is that I may have held out false hope to many desperate people.
If journalists had not told this story – and the truth about crimes by banks – then the banks’ version of history would prevail: “Millions of Americans woke up one morning and decided to be irresponsible deadbeats. More, faster foreclosures will save the economy.”
I admire the hell out of you and 60 Minutes for running this story. I sure did expect more courage from prosecutors and legislators – but I am finally, at age 62, cured of my naivete.
I look forward to the story about the banks being brought to justice.

I would also like to ask WHY do the banks refuse to negotiate with the homeowners…Because they don’t have to. Does the FDIC give them up to 80% of what they have lost in a foreclosure? Perhaps if that stopped then they would be forced to work with homeowners. I haven’t met ONE person that has had a mortgage redone…either you make too much or not enough…you have to be late to be considered then when you are your too far behind…

I can’t tell you how much this information has helped. Steve, Leticia and Nancy I have signatures of Michelle I Miller also if you want to compare. Also of a T. I would be so incredibly grateful for any info you could give me. I’m in california.

Agree with ReadDocs. Speaking of consumer’s protection, Apple released an iPhone app a few days ago, called Scam Detector, which exposes 350 or so of the most popular scams in the world. Most of them are real estate/ property scams. It might be worth checking it out if you have an iPhone, or work in the industry. It’s kinda cool, actually.
Title Companies are aware of all this.
Before buying a house, require the Title Company to sign an agreement stating that the title is clear.
Do this as a notarized statement , not just accepting the policy which may have LANGUAGE KEEPING THEM OUT OF TROUBLE AND GUARANTEEING NOTHING..
The Title Company Policy required at every home sale is where the banks have real trouble. Since Title Companies know all that’s recorded OR NOT against the property, getting them to guarantee the Title if its not completely clear is impossible because if the Title is proven to be wrong they alone must pay up to the hurt homeowner, not the bank or lending company..
I don’t know anyone in their right mind who would buy a house right now in the midst of the biggest mortgage fraud crime wave in history…
I have recontrust with both Betty Jo Livingston and T Sevilano and my favorite they sent me a copy of my Betty Jo word for word with the one I have signed except she did not sign it yet so it’s sitting in all my papers waiting to be forged now we know how they seen to all ways come up with what they need I all so have just the letter E that is supposed to be E Espana the notarys are A Calderon with a signature that looks like they superimposed one , signature on top of another, a J kooh who can’t even spell her four letter last name and they did not even bother to have Betty jo notrized
IMPORTANT: I have a meeting with the San Diego County Recorders Office next week to present many
exhibits that I have collected to present of three Notary’s signing forgery’s on recorded documents in San Diego.
These notatry’s are 1.) Ahmad Afzal CA Notary, 2.) Michelle Miller Ca Notary, both from ReconTrust and BofA, and 3.) Linda Green . If any one has any other recorded documents of theese individials or any other Notary’s establishing forgery when comparing their signatures to their oath please forward them to me.
WE NEED TO STOP THIS. IT IS A FRAUD AND A FELONY.
JUST THINK IF YOU OR I DID ANY OF THESE ACTS WHAT OUR PUNISHMENT WOULD BE? WE WOULD ALREADY BE IN JAIL.
ARe you going after the notaries? They have to have a bond of at least $15,000 but they should be held liable individually because we Notaries know that we are not to notarize a document without having established the identification of the signer and witnessed the signer sign.
HOw do we reach you if needed?
I found a Michelle Miller. The other two do not appear on the active notary list. I did find other notaries who are from ReconTrust.

Steve I live in San Diego as well who are you trusting with your complaint I was thrown out of court because the judge said I only had copy’s I told him every body only has copy’s because if they brought the real ones in to court they would go to jail for fraud he told me not to say another word or he would have me arrested for content and refused to let me show proof so that I could get it in to the record for appeal

You might think that you gave false hope to many but we will remember. This generation may be the ones that are thrown out of our homes and abused by the banks and the courts, etc, but we will remember and we will teach. We are not dead yet and millions of us have decades in which to teach and remind not only the bankers but our children and our children’s children what we endured and make sure that it never happens again.
Justice in America is bought and paid for by corporations. The only way America is going to awake from its slumber is through knowledge. Alot of people do not care because they believe that they are not affected. America needs to wake up before all our fundamental rights are taken away. We must support each other and demonstrate to those in power that our rghts and concerns are to be taken seriously. We must be proactive. We can demonstrate, stop purchasing goods and services from companies that violate our rights etc.
Consistently more and more people are becoming aware of the crime wave crossing America
over and over. I am talking to folks who are not on the internet and they are beginning to be
aware of the facts. More and more small local newspapers are beginning to investigate and
report their local crime wave of real estate/mortgage/foreclosure fraud. They are beginning
to learn how much this impacts them and the cost. More and more people are beginning to be
aware of how easy it is now to steal a home right out from underneath a family member, a
neighbor or a coworker.
The facts are beginning to flow. People need to know they can vote with their feet, their money,
and their political votes in containing and exposing the banks. The people who run and control
these banks need to be held accountable for all the laws broke, the damage they’ve done to
our nation, the economy and to the families destroyed through their greed.
Yes Readsdocs, Foreclosurefraud is bankrupting America because it is causing massive losses of property tax revenue to the States…..People who are still paying their mortgage think it is the right thing to do but they are really only aiding and abetting these same financial terrorists to keep their Ponzi Scheme rolling by re-manufacturing the same fake debt over and over again… That is causing economic stagflation……..The media and Washington are Foreclosuregate….They are covering up the truth to keep their PONZI SCHEME with TREASURIES rolling at the Federal Reserve and at the U.S. Treasury..Bloomberg reported a few weeks ago that the Federal Reserve collects trillions in mortgage money and they buy TREASURIES with that “money”….The Government and the judges and the attorneys are all acting like S.S. soldiers for this Nazi New World Order regime and are protecting the assets of the foreign elite who set America up to fail and robbed us blind and still are……….This is the Fourth Reich and they have come to roost in THE UNITED STATES OF AMERICA…disguised as Americans and American institutions…..
