Fraudclosure | Pasco Couple Fear Losing Home to Foreclosure for Paying Bank of America Too Early

“In accordance with the Trial Payment Letter dated December 15, 2010, it indicates that if you are not able to make each payment in the month in which it is due, you will not be eligible for a modification under the Home Affordable Modification Program,” the letter said.

So, they make the payment EARLY and since it was not made “in the month it was due,” they get fraudclosed.

When is everyone going to get angry enough?

When are we going to put a stop to this madness?

The abuse by the industry has been going on for years now and it will not stop until you do something about it.

Pasco couple fear losing home to foreclosure for paying mortgage too early

NEW PORT RICHEY — Seventy-year-old Sharon Bullington may lose her home because she paid her mortgage a week early.

That may not make much sense to the thousands of homeowners who are behind on their mortgages in Florida. But it seems it does to Bank of America, which has filed to foreclose on Bullington and her husband, James, 78, who is terminally ill.

“It’s like death to me,” Sharon Bullington said, her voice quivering on the phone Friday. “My husband is bedridden. It’s almost more than I can bear.”

The couple moved to Florida 15 years ago after James Bullington retired from General Motors in Flint, Mich., and moved into the 1,591-square-foot New Port Richey home, which is now valued at $133,464, though they owe about $177,000.

When James became ill, the couple encountered financial difficulties because of high medical bills. The couple asked Bank of America to modify the loan.

There was a catch. The couple would have to first officially default on their $1,400-a-month payment. The couple did that and entered into the modification plan, which reduced their payment to $916.

Sharon Bullington made the January payment on Dec. 23, and the bank accepted the money, according to court records.

The next month, she made the February payment over the phone. Weeks later, the money had not been withdrawn from her bank account. After Bullington asked the bank about it, a representative told her she had punched in the wrong routing number. In March, the bank kicked the couple out of the modification plan.

Bullington pleaded for help in a June letter to Bank of America president Brian Moynihan and U.S. Rep. Gus Bilirakis, R-Palm Harbor.

One of Moynihan’s aides, Ana Olivera, told Bullington the foreclosure could not be stopped. She wrote in a two-page letter that the payment due on Jan. 1, 2011, had been made in December.

So they fraudclosed..

Thought all you “friends” of BAC might enjoy this parody I wrote in their honor (sung to the tune of Neil Diamond’s “America”):

    Received billions in TARP
    We take your homes
    You sleep in your cars

    We’ll get off scot-free
    Lawyers huddle close
    Then pay off the AG’s

Own the Prez and now your place
    We’re Bank of America
    Stealing homes at record pace
    We’re Bank of America

Homes, dump them back on Fannie Mae
    We robo-sign and that’s okay
In the eyes of the courts
In the eyes of the courts

Loans, what we hold is toxic waste
    But mark-to-model is our case
    Makes shareholders feel warm
    Makes shareholders feel warm

    Accounting from the netherworld
    We’re Bank of America
Our real books would make you hurl
    We’re Bank of America

Gotta scheme not fair or square
    We’re Bank of America
    Turn your dreams into nightmares
    We’re Bank of America

    We’re Bank of America!
    We’re Bank of America!
    We’re Bank of America!
    We’re Bank of America!
    You pay! But can’t stay!

    My country disses me
    Where’s justice and liberty?
    To freedom we do cling
    A pitchfork I will bring!

The biggest problem, I think, is what manifests when the Paln beach county chief judge says, the other day that….foreclosures will now pick up again because the banks are now getting their paperwork problems cleared up…….bullshit…and he knows it! Too many officials are on the take and they and the judges are protecting the……….BILLIONS OF MBA INVESTMENTS! If we are going to find freedom in fair judgement, then all of the criminals must be neutralized!

    • Those paperwork problems were and are fraud….what he forgot to say was fixing the fraud with fraud….that judge is well aware that those days are done…there is no fixing any papers…Does the court allow a bank robber to put the money back in the tellers drawer and walk away scott free with no record or prison? .Wake up courts….you are no longer the Court of Juctice….time to stop pretending.

it’s not surprising that obama is pressuring schneiderman to whimper and cave into the bank crooks.
obama is owned by the banks.

obama can’t walk 10 feet without running into a goldman sachs toadie.

i hope schneiderman stands firm and protects new yorkers.

    • lvent says:

If AG Schneiderman caves Obama better resign because the people are near the breaking point…One more false move like that by Obama, Congress, Geithner or Bernanke like a settlement with the banksters to legalize fraud or another bailout for the Wall Street crooks in the form of a QE 3 could send this country reeling into something very sneaky and underhanded by the american people…they all just might be digging their own graves if they pull another cheap shot on MAINSTREET..

      • Fury says:

i really think that people are fed up.
the MSM is not showing what is happening around the country and the world.

people are taking back control. they have lost trust in their governments, courts, police and banks.

i watched an interview w/ some of the kids who looted in england. i don’t condone it by any means but
when you hear them talk about the banks getting away w/ stealing, they felt they would do it too.

they had no jobs, no money and no future.

this is the damage that has been done to the world by the greed and avarice of the banks.

they need to be punished. they need to be forced to give our stolen money back or there is going to be hell to pay.

      • Fury says:

it’s ironic that the banks in england have stolen hundreds of millions of pounds
from the people, destroyed pensions and ruined lives but they have not been arrested while the looters are seeing swift justice and are being sent to jail.

      • How did you like Ms. Wylde’s remark to AG Schneiderman….” Wall Street is our Main Street…lov ’em or hate ’em.” …..what a wench….Any time the other side starts the pressure…that tells you to go in the opposite direction….pressure is a form of force…’s not a free choice or voice. that is the same method used in CONgress….it is not was is good for the people…it is what lobbyist got to who first…than the pressure is turned on to others to sway the vote. Betcha money is doing the talking in this case….AG Schneiderman would be smart and stick to his ‘ guns ‘….he has the ammunition for defense….swaying his opinion will cause tempers to explode…..the people are very close to that already.

wall street is not NYC’s main street.

        it is Broadway.
        It is Madison Ave.
It is Ave of the Americas (where the Fashion District is located)
or hundreds of other important streets that reflect the makeup of NYC and what it inhabitants create for the world.

        wylde is like Marie Antoinette.
she is clueless to the suffering that has been caused by her FED,
banking, and wall street gangsta cronies.

  3. lvent says:

Sorry Readdocs, I spelled your name wrong it was not intentional.

    • lvent says:

Various reputable sources have pointed to a few good weapons to use to fight these crooks could be:
The Allonge-Billions of Dollars in Commerce Hangs on A Single Scrap of Paper:

At the end of the day, It is the owner of the mortgage note that dictates ownership of the mortgage ( a premise commonly referred to as “the mortgage follows the note”) as evidenced by Article 3 and Article 9 of the UCC Code in effect in all states..
The pretender lenders are using fraudulent, phony docs trying to recreate chain of title and robo-signing docs years too late for problems that have no legal remedy..Whoever is the last pretender lender holding the hot potato are trying to cover up one of two things:.

Either the loan never made it to the pool because it was not endorsed when it was performing (or because the loan otherwise failed to meet the standards of underwriting set by the PSA) or the loan did make it to the pool in breach of the terms of the PSA, in which case the Trustee of the pool will be sued by the investors for damages.

Analyze your states recording laws and statute of frauds…..the industry had to create, fabricate and even destroy very important docs to recreate or conceal their frauds and abuses.

  4. housemanrob says:

They don’t modify……..vecause they cannot!……they are a pretender lender…..without standing! Who has standing? You can bet……it is only the homeowner!

    • lvent says:

houseman, did you read Nye Lavalles report?…..the debt the Ponzi Schemers created is overlevaged, it is 30:1..There is 40 trillion in fake, fraudulently induced debt because of the multiple pledging of notes to multiple trusts……and there is only 8 trillion in back that up….The TBTF are insolvent and this fake debt is unsustainable. The judges must know,….If they took every house in America, the trusts would still be empty..there pension funds have been looted and stolen to cover for the scam and.there is not enough assets to cover the Ponzi Schemers bills in order to pay their investors on the entire planet…..Nye Lavelle says this Ponzi Scheme is Enron times trillions..This Ponzi Schme was and is .pure evil…

  5. see says:

And if her payment was processed a day late there would be the same scenario. BoA knew about her situation and they set these people up to fail. They were going to get the house no matter what. Makes me sick and yes angry to no end. I believe that one day God will deal with sick poor excuses of so called human beings in his own way. My prayers go out to this elderly couple.

  6. Readdocs says:

No one is blaming the victims. It’s time to start thinking, not reacting. The mind the
most powerful tool man has, that can bring about influence and inspiration.
And if what you’re being told to do doesn’t work, do you just keep on doing the
same broken thing, or do you change your course?
The lady who is fighting to keep her home needs to be inspired not told she’s
nothing but a victim. She needs to know she’s not helpless, she needs a new
direction. That’s what this site is all about, knowledge, inspiration, honor,
    courage, and decency.

    • REDDOCS….You say it is time to start thinking…NOT REACTING…..Are you saying we have not been thinking…using the tool we have..the brain? That is an insult to come on here and say we must start thinking…. And not to react ?? Reaction can be for either the good or the bad. Our reaction is to oppose the criminal actions being forced on everyone. This my friend, we must do…REACT….and that is the fuel along with our thinking that will drive the forces.
You mention the lady in the comment…if something does not work in one direction…to take another direction…..that crap does not work in the foreclosures….are you on the same planet as millions of homeowners are…that have lost their homes along with everything else? There is no directions…as of is a one way street….their way. …Unless you know something no one else knows…Have you any ideas to help the lady….I am sure she would appreciate any you have.

      • Readdocs says:

Firstly the name is readdocs, for a reason. Secondly there’s no need to YELL.
Thirdly, why are you getting insulted by a neutral comment?
I am speaking from personal experience. I am reading, listening and trying to
learn from this site and others I visit.
I have learned enough to know I need to educate myself so I can avoid another
experience, and how to protect myself in the future.
My history has taught me there’s a need to think outside the box.

      • Fury says:

i believe as you do. we are all fighting every which way we can.
we have seen incredible fraud and the perps are continuing to rip people off with little consequence.
we have seen courts ignore evidence.
we have lost everything but continue to fight these evil criminals.

it doesn’t matter if you have read your document when you discover years later that the document you read and signed has been altered, the Bad Guys continue to alter documents and submit false documents to the court w/ no penalty.

      • lvent says:

Readsdocs, Marilyn is one us, and she really gets it.. These crooks and sheisters are trying to divide us and we can’t let that happen..They have already stolen our wealth and prosperity and many homes and they still are.. Now they want to acheive their final evil plan and steal our country and they want a rent-a-center of America.. We have to be indivisible here as we are all trying to figure out the best way to get even. We need a plan.

      • Yes. I know your name….it’s readdocs….maybe I should go by my hidden name of Bluecrab….and there also is a reason I most often use it. But here I prefer to use my name…I am not in foreclosure…and never had a mortgage on my home….BUT I do fight the good fight for all those who have been abused and are victims of the criminal actions of the hidden secret society that has done this to America.
And where do you get I was yelling? Was my comment in capitol letters or what? I thought you needed to know… people…many people have been thinking and searching for many years now over this massive mess…it just didn’t start.. Our brains are filled with every step involved with what has gone on and is still going on. One can only think for so long…than the issues are just a repeat done over but in a different fashion to throw off and stall the people from ‘ reacting ‘.
I felt your comment on thinking and NOT reacting was not what we are after…it has been said over and over…why is no one protesting…where is the anger?? Why are we not marching by the thousands…why are we allowing this to continue??? Experts are now demanding from Washington….We have done the we must react to the anger built up inside of all of us…marching united together. We have the standing…we owe no one…..our mortgages are paid…..follow the money…And you are right…you must think outside the box……..none of this was ever taught in our schools.

    • Fury says:

what makes you say people are not thinking but reacting?
we all have been thinking and doing.
that is why we are here.

this woman needs help – not monday morning quarterbacking.

      • Fury says:

i would hazard to say that most of us read the papers we signed.
it was only afterward, that we discovered we had been defrauded.

all of us have been defrauded in different ways — the different scams that the banks
        were pulling.

this poor woman was conned. she did what the bank told her to do to save her home.

so, i have empathy for her. we have the advantage of 20/20 hindsight.

i want her to get help; help in caring for her dying husband and help in order to save their home.
        she doesn’t need criticism.

  7. Readdocs says:

People need to stop running on emotions when something like this happens.
The money changers have never cared, do not care, nor will they ever care.
They will use any instance to cause default and carry on with the next customer.
Being alone with an ill spouse should have alerted her to the many traps
that can be laid for the unknowing.
She should have been suspicious and untrusting when it comes to dealing
    with money.
    Money corrupts, ALWAYS
Until we as consumers learn to always watch our own backs, and know we
always stand alone in financial crisis this will continue to happen.
The robbery, graft, and greed are not going away.

    • Fury says:

the wife is an elderly woman caring for a dying, bed-ridden husband.
they have no children, so she is doing everything by herself.

she did want the bank told her to do.
      don’t blame the victims!

      • Fury says:

“running on emotion” is exactly what needs to happen . it fuels action.
it shakes people out of complacency. it brings a return to empathy and looking out for your fellow man and woman,

i want more outrage not less.

  8. Ron Moss says:

    bank comtinues to play “Gotcha”

    • Ron…Yes. they continue to play ‘ gotcha ‘…..ONLY because this country has not got off their duffs and stood for what is right…stood for justice….stood up to this corrupt government….millions protesting WILL get action….that is the only solution to combat this whole frigen mess. Words will not do it. alone…but if they see and hear the anger you better believe the tide will turn….we can’t wait for electioins…we need to attack the problem with the force of power….we have not seen anything done yet to rid the seed that has cause the problem to begin with….and it will continue because they are laughing at the weak Americans who have done nothing….ANGER AND HATE IS A FEELING…AN EMOTION….AND YOU SAY TO STOP RUNNING ON EMOTIONS? THAT IS THE FUEL THAT DRIVES THE FORCES…THAT WE CANNOT AND WILL NOT STOP….THE FIGHT MUST GET STRONGER….SOON…… WE HAVE GIVEN TO MUCH TIME FOR ALL OF ‘ THEM ‘ TO PAD THEIR EVIL.
