FHFA v Boa lawsuit includes a tranche/class of the REMIC Bank of America Funding STALT 2005-1F.  The payment stream from loans in group 4 were in the tranche that is part of this lawsuit.

“Original Note” – was “lost” then was “found” – no endorsements on front or back of any page – MAJOR PSA violation

 

Assignment of mortgage to “US Bank National Association Successor-In-Interest to Wachovia Bank NA as Trustee for BAFC SALT-2005-1F.

 

Certificate of title issued to Suntrust instead of the trust regardless of previously assigning the mortgage to the trust.

 

THEN Suntrust SOLD the property for $78,500! – Did the trust get the proceeds?  Property appraiser info here.

    Can someone give me the ramifications of this in ENGLISH please? Why is this ruling important?

    My own mortgage is supposedly held in a US Bank Trust, and serviced by BofA.
