REBA is not aware of any circumstance where the grantor bank has attempted to disavow the validity of an assignment or discharge because of a robosignature nor do we expect that such an attempt would be successful.

In conclusion, we find no persuasive argument that robosigned documents are forgeries. Lacking the intent to defraud, they are more than likely being signed with authority of the named signatory. Were they found to be forgeries, there is no legal support for a register to reject a document based on a good faith belief that a document may cloud title.
And then came the intimidation, blame and the threats…
By suggesting, without adequate support, that the registries are full of fraudulent and defective documents, clouding thousands of titles, YOU are adding to the public’s confusion and hesitancy to re-enter the real estate market. YOU are also giving unwarranted support and hope to parties in foreclosure by suggesting that a robosigned assignment in their chain of title may prevent the foreclosure. At the moment, to the best of our knowledge conveyancing attorneys and title examiners in Massachusetts are not treating robosigned documents as defective.
The association plans to seek the support of the attorney general’s office and the land court in requesting that you retract your current practice of refusing to record said documents. We ask that you cease this practice immediately.
Then REBA sent a letter to Attorney General Martha Coakley…

Letter to REBA’s President Edward M. Bloom
Love that guy, he is sharp man. He took the time to look into all the Damage MERS created with his registry. I wish Hampden County Registrar would do the same. I dont think anybody “gets it” in the western part of Massachusetts. John Obrien is on his game and he is merely supporting what is right and just and trying to preserve 200 years of issue free traditional registry. Not to mention collect on monies owed to his county.

Tee, I am from WMass. Mr. Ashe was ignorant at first. He is now involved in this issue, as are all the MA RODs. I have been pressing this issue with his office, and the AG for a couple of years. I even made State Rep. Baldyga aware of the MERS scam. Every ROD is going to be audited.
I told the AG that if MERS was legal, I was going to create an RMV based on the MERS model.
When I die…..I want to come back as John Obrien….what a brilliant response…bet they are scrambling for answers over at REBA!

ROB…..My family all moved here over the years… my Mom first and than my 2 sisters…I moved here right after 2001 after buying a house in Fall of 2001….and it has been hell since. First I lost my Mother….than the real hell started…..the only thing I see of beauty left is the sunset over the Gulf…..sitting on the bench….cause the sewage may be in the water from the pipes so outdated. Yes..I no longer smell the orange blossoms….I smell fraud…………
How poetic Marilyn…….but you could have left out the sewage part. I try to appreciate the little things in life, they are precious…….especially now….after losing my wife, my father and my second best friend (my wife was my best) on 3 consecutive days in early 2011… and it is my love for the little things in life that keep me going……. like walking the beach at sunrise!
Well…Is this whole state corrupt or what? Is this state so wealthly they don’t need the money…if that is the case I have paid those same ‘ fees ‘ 3 different times in Florida and I would like a refund….if they don’t have to pay than I shouldn’t have to pay and all in Florida should get refunds…….we were not corrupt and should not have been charged for being honest…….Isn’t that right Me. I like to place this issue in a much simpler context. If a private entity created a shadow registry of motor vehicles, would the government still look the other way?
Law enforcement would be nearly shut down. Anyone could drive an unregistered or uninsured vehicle (because the cops would not be able to send a citation to the true owner of the vehicle), there would be no more excise taxes, anyone could blow through a toll booth, parking tickets could not be given, etc.
MERS is a cyberscam…..they don’t own anything….
