OneWest Bank DOES IT for Lisa in Massachusetts! (DOERS ROCK!)

It all started early last Saturday morning when I got a call about a homeowner in Massachusetts scheduled to lose her home to foreclosure sale in just two days…

Now, I don’t mind telling you that I had just posted a DOERS ALERT the day before, and to be honest they’re all a lot of work and I really didn’t want to have to write another one the very next day… I was exhausted and looking forward to sleeping for the next couple days.

The client’s name was Lisa Ferrecchia, who I was told was one of the thalidomide babies. At the time, I did’t know if that meant she was part of a sister singing trio… you know… The Thalidomide Babies,” or what, but I’d soon find out.

So, I read about thalidomide and OneWest Bank most of the day and then started writing a DOER ALERT, which was finally ready to post at about 5:30 PM on Sunday afternoon. I was beyond tired and feeling kind of awful, if you must know. I hadn’t been outside of my study for yet another weekend straight… my wife wasn’t saying anything, and my daughter was saying she missed me. But what could I do? I mean, seriously? Lisa Ferrecchia’s home was to be sold the very next day at 3:00 PM in Massachusetts.

Plus, in Massachusetts, do you know how they do it? They auction the home off right on the soon to be ex-homeowner’s front lawn, for all to see. I’ll tell you what… that is some 17th century nonsense right there. As in… Me thinketh she is a witch! Aye, a witch! Might as well be making the homeowner walk around with a scarlet ‘F’ on his or her clothing. I figured that Lisa had probably spent a lifetime seeing people stare at her, and the thought of her home being auctioned off in front of her neighbors… well… that just was not going to happen. Not today.

 

 

I had spoken to attorney Glenn Russell early on Saturday, and told him to have a skeletal bankruptcy filing ready just in case. I had just spent the whole weekend behind closed doors in my study typing and posting at 5:35 PM on Sunday, I wasn’t at all sure my DOERS would DO it in time… or even could DO it in time. And if that was the case… why the heck did I just blow the whole weekend with my family… again. I was conflicted and unsure of everything.

To make matters even worse… and I wouldn’t normally share this publicly… but Steve Diberrt of MFI Miami called me on Sunday evening… he was in Denver for something foreclosure-related. He had read my DOER ALERT post and asked me what I was doing about Lisa Ferrecchia. I said I posted a DOER ALERT and my DOERS would handle it. He asked if I had called Glenn Russell and if Glenn was going to file a TRO, etc. etc. to stop the next day’s sale. He asked a bunch of other technical legal questions until I had a headache.

I said there wasn’t time for any of that, but my DOERS would handle it. He wasn’t buying any of it. I said, don’t worry… I’m sure it’ll be fine.

And he replied: “Dude, I think your nuts. I’ll call Glenn and find out what else can be done.” He hung up.

“Oh, ye-of-little-faith-shithead,” I thought to myself.

We all know what happened next, right? OneWest Bank’s CEO emailed me late on Sunday night saying that he’d look into the situation the next morning… and the next morning OneWest contacted Lisa… told her that the sale had already been postponed… and that they’d do everything they could to get her a loan modification that would allow her to keep her home. I wrote to tell everyone the good news, and said that I was certain that OneWest Bank would do exactly what they had promised. Of course, not everyone was sure whether I was kidding… I was right… or I was a fruit loop.

One West said that they would let Lisa know by today… Tuesday, February 7, 2012. And so here we are…

Yes, ladies and gentlemen, it’s a HAMP modification… 2 percent for 40 years.

Her mortgage payment went from $2700 and change… to $1500 and change.

DOERS you DID it again!

    It is a sad day to con-d into a contract to which there was no contract in the first place. Where is the real justice here? Mandelman I applaud your tireless effort to help, but did you really get honest justice out of this or just a quick fraud fix?
    I have not paid my mortgage in over 3 years and now bank of america transfered or sold the “servicing rights” to some “Bottom Feeder” in Colorado. Arizona just passed a law yesterday to lower the underwater homes for homeowners from their lenders. This is all fine and dandy but I don’t have a lender, I have now a second rate servicer from Colorada trying thier best to forclose on me.
    I have refused to sign any modifications from Bank of America, for which I believe it would be entering into a fraud contract to which there is no contract to start with. Show me my Note and original Deed ……………. No on but no one can show me this. SLS Servicers of Colorado says they have a copy of my note and I ask them to send it to me. What I got was a copy of page 17 of my Deed of Trust. REALLY ! Now I have 8 copies of my Deed of Trust. 7 of which came from Bank of America.
    I am so beside myself. and even tho I read all these articles and posts. I still wonder what the hell is going on and where is the Justice in all this.
    I am all most at the point of letting go …… but I can’t. I can’t let it end this way. Americans …. True Americans have always fought for Justice in any means they seem fit. I guess I got to try a little harder.

    P.S. mr mandelman, I’m miss mandelwoman, aka the loan ranger, been in “law school” researching my loan that is fraught with fraud, it’s SO CRAZY!!!! and I have been reading 4closure fraud, every article for 3 weeks plus now and American Banker articles (but my free 2 week subscription just ended). I have proof, evidence of how they did it, how they stole my mortgage and did the fraudulant assignment of Deed of Trust. I’m praying I can get a word in with my AG, cuz I’m tellin ya, what I have would shock the shiza out of them. Well, my house is up for trustee sale (not the REAL Trustee) but the fraudulantly appointed one on the 9th, yep tommorrow, and though i have the info and now know how to do the TRO and injuction, motion, etc. there’s no time, so now I’m doing credit counseling online and going to pull another all nighter and going on yet, not another weekend, but a 5th week of my kids and life missing me. I pray I can get it done, cuz if they get away with this and not answering any of my qualified written requests, well, this country won’t be going to hell in a hand basket, it is hell in a hand basket. And I paid as a down payment hard earned cash, more than this house is worth now, more than $140k. This has made me so sick and made me go from a happy-go-lucky person to a….well, I barely feel human and the shock of my discoveries have been so harsh, I can barely eat. I have lost so much weight. 5’3 1/2 inches and 102 pounds…I’ve lost 35 pounds without even trying or needing to. I pray I can stop it, but I need a lawyer, cuz now I’m gettin into deep waters, but I’m doin all I can but I think the mob has bigger guns and deeper pockets….but I have faith and God, so I’ll continue with yet another all nighter

      Cindy, when we find out the truth about what all of these dirty criminal bastards have been getting away with, ever since CONgress created the UNCONSTITUTIONAL and therefore ILLEGAL FEDERAL RESERVE…it can make you sick. There is a disclaimer at the right..READ AT YOUR OWN RISK. But then most likely, you will just get really pissed! Tell them that they are all full of shit, unless the can show you a receipt, proof that they have a legal and Constitutional right to take your home.. Tell them U.S. PROPERTY LAW SAYS THEY NEED TO SHOW YOU PROOF THEY PAID FOR YOUR LOAN. Tell them, that you never got a check at the closing so therefore, they never lent you any money and that DEED OF TRUST CONTRACT IS A FRAUD..! Tell them therefore the entity trying to take your home is an imposter, a thief. Tell them that, you are a U.S. CITIZEN and your PROPERTY RIGHTS are protected under the U.S. CONSTITUTION..and therefore, you refuse to leave. This may not be construed as legal advice because, it is not, it is your legal right to do so, as a U.S. CITIZEN, living under the protections of the U.S. CONSTITUTION and the laws of THE UNITED STATES OF AMERICA.

IF NOT, AND THEY DID NOT HAVE THE RECEIPT PROVING THEY ACTUALLY PAID FOR HER LOAN…SHE JUST GOT SWINDLED AGAIN INTO ANOTHER FRAUDULENT INDUCEMENT! STOP THE SWINDLE OF THE PEOPLE!!       AND THE TRUST AGREEMENT…FROM THE ORIGINATOR TO THE SECOND BANK..THESE TRUST AGREEMENTS CAN ONLY GO BANK TO BANK…THEY HAVE NO MORE THAN 90 DAYS FROM CLOSING TO DO THIS PROPER, LEGAL RECONVEYANCE..OTHERWISE THEIR CONTRACT IS A NULLITY…THERE IS NO LEGAL FIX FOR THE ORIGINATION FRAUD.

    Hi Martin,

    Good for you and good for the doers! I will give your email alerts priority status. We are swamped here in NJ with a biased bench of judges. Keep up bthe good work and keep track of Lisa’s modification. All too often I have seen court ordered mediaitions fail. My home was auctioned off while in a HAMP mod. I managed to get it vacated.

    Some people are satisfied with a mod and can’t deal with the brutal fight. Different times and situations in life really factor the play. Maybe she’s okay with the credit hit and can bounce back and not forfeit her employment and/or business. It’s a personal choice. Some of us battle the fight to the very end for major reasons and the investment of the fight will make or break every day life. Please don’t criticize this home owner. She deserves so much more. I personally would’ve taken the same two or three years ago.

    and we still pay for a upside down piece of property we will never own with NEW rules attached and we will never know the NEW RULES if that truly matters with all of the lies …great she does not have to move but comon!!!         The only difference is, well, they are actually con men/women…acting like they want to “help you” but can’t help you unless you send and sign all the loan mod paperwork. Which actually seals the deal for them and assists them in robbing you. They have the nerve to demand the paperwork, yet they can’t guarantee a loan mod or anything and especially won’t give you (or me) any paperwork. All I keep hearing is…”it doesn’t matter who owns your mortgage loan, we have full servicing rights.” Or they tell me, “I don’t understand what you mean by “who is the lender/creditor” you aren’t being clear in what you are asking. And then, over a frickin hour, they bounce me from one customer service rep to another…but under the premise of, “hold on while I check.” Then that God awful music comes on and wtf! Right back to the beginning as if i just made the call and have to give all my info again and ask again the same question. This went on for a frickin hour as I got bounced to 5 different people. And none of them knew what I was asking, they all had the same answer, “we are servicing your loan.” I kept telling them that I knew that but I wanted to know who they were servicing it for? who was the lender? the creditor, who owns my loan now? And their universal response as I said (but I just can’t believe it! I’m in perpetual shock!!!), they all say, “I don’t understand what you are asking, you aren’t being clear.” Any suggestions how I could say it any clearer so that maybe a third grader would understand?

        @ Cindy – don’t fret too much about not being clear. These people are trained to say just that….not to commit to any facts, why? Because the fact is you don’t owe them a dime! Without having to repeat what has been on this site over and over and over and over again is the ponzi scheme that has swindled all of America and it’s wealth. Ivent can and has posted this explanation so many times I think I have it in memory by now! For some it sinks in; for others it is just way beyond their comprehension. The American people just cannot fathom that THEIR government is that corrupt and evil and been going on way before the days of JFK…but, we became apathetic and unaware and thought life was a bowl of cherries. This same scenario was true for those in Germany when Hitler came to power. Keep filing your motions; keep sending out your QWR’s and keep fighting. God has always had ‘warriors’ fighting evil so have faith.
