Foreclosure Settlement Fails To Force Mortgage Companies To Improve
NEW YORK — Katie Diaz arrives at the Bronx County Courthouse hoping for clarity, if not a reprieve from the foreclosure case threatening her home. Five months has passed since she submitted an application to Bank of America seeking lowered mortgage payments. She is eager for a decision -– an approval, a denial or at least a negotiation.
She gets none of these things. Instead, in the course of a perplexing morning spent beneath the dim chandeliers of Courtroom 607, she absorbs a display of the chaos that still besets the nation’s foreclosure proceedings, despite promises of improvement from major banks under a settlement with the Obama administration and state attorneys general.
Diaz, 52, is here for a settlement conference, a face-to-face meeting of lender and borrower mandated under the foreclosure process in New York state. As soon as she sits down at the wooden conference table, an attorney representing Bank of America confirms that she is under review for a loan modification. A few minutes later, the bank lawyer corrects himself: Her case has been closed, he says, because she supposedly never sent required documents. Fifteen minutes after that, he corrects himself again: Her file was never reviewed, because her paperwork has been sitting in the wrong office inside Bank of America.
“This file has just been sitting in a dead corner somewhere?” asks the man presiding over the conference, a court-appointed “referee” Steven Konigsberg. “No one has looked at it?”

The banks CANNOT modify or refinance any loans that are through MERS because they do not have the “notes” to negociate!! You can’t buy or sell a car without the ownership documents so either can they!!!
Everyone needs to pull their money, what little they have, OUT OF THE WALL STREET BANSTERS…open a new account at your local credit union…Credit unions are operated by the members for the members….hit the banks where it hurts by withdrawing all your IRA’s, CD’s, savings and checking…get away from them and STOP dealing with them…they will not and cannot negociate anything with you because they can’t!!! That is why they are lieing and using excuses that YOU didn’t file the right paperwork…BS…it will always be BS because they don’t have the ownership documents…they really have no idea who owns the docuemtns because they sold them so many times in their “bundles” to so many countries around the world…the banks MUST attempt to foreclose in order to get you out of the house they don’t own and re-sale it to create a NEW NOTE!!!!
Don’t leave your house and pull all your money out…then take to the streets and protest all you can…put a sign in your car, stand in front of local banks…sooner or later our voices must be heard or w will become a homeless America!!
GET MAD and Do something other than hiring an Attorney who can’t do shit…get away from the courts…the banks are stealing our homes and the courts ARE allowing it to happen….GOT IT!!!
There is nothing being done because the courts are also tied into this because their pensions are on the line by these banks. Just follow the whole money trail and you’ll be amazed by what you find.
So it’s actually a conflict of interest with the courts. NOW this is why they can’t get involved.. IT’S NOT A FAIR hearing or trial for you.

Wow …. You have it! Times Ten. …. Calling the Arizona Consumer Complaint Dept was one of my worse experiences ever. She tells me the Note does not mater. Electronic Documentation is upheld in the Courts of Arizona. She asked me who ever told me the Notes were Scrutinized and turned into Securities didn’t know what they are talking about. Notes were never destroyed or turned into Securities. She is the Head of the Consumer Complait Dept and I might as well have been talking to the Wall. I came away thinking that even though nothing was recorded from my original lender to Countrywide, nothing recorded in MERS and now I have a robo signed document posted by BofA in the recorders office stating that it is in the hands of Bank of New York Mellon, I am Fk’d Fk’d Fk’d.
No one but no one will help. Lawyers want more then the house is worth and they don’t know a Fking thing about this. This is a total Republican State and a Fk’d up State of Affairs. They are going to rip off the DOJ settlement as well …. just wait and see, for the same reasons you had just described …. I know it and I can feel it in my bones.

The banks paid off the gov’t to avoid prosecution…plain and simple. . Now the burden of suing the banks falls on us homeowners. God they must think we’re stupid.

The “settlement” was a bailout. Servicers have continued the same operations as before. The “settlement” was a big head fake. Careerists Tom Miller, Eric Schneiderman, Holder, et al sold out to political convenience. They don’t care what happens to you, just like the Banksters. They will never hold Wall Street to account for anything, scandal after scandal, from LIBOR to you losing your home.
As long as money is made doing what they are doing, nothing will change. Any agreements will be an attempt by those banks and mortgage companies to keep this going longer.
Anything will be agreed to just to stop any decreasing in the making of more money.
Until agreements stop and enforcement begins, nothing will change.
When one side is negotiating honestly and the other isn’t, this will not be resolved except in the one gaining by dishonesty’s favor.
History of the Native Americans and US treaties shows how this worked for the US and now how the same tactic is working against.
