					<description><![CDATA[Of course the banks knew they were defrauding people, paying loan originators and mortgage brokers high dollar to &#039;boost&#039; the type of loan product you received. The higher dollar yield the more was paid under the table or in commission to the brokers and originators who &#039;sold&#039; the loan. This was the crime that so many fail to see and think people were just deadbeats on liar loans. Not so, Many of us had good credit scores and could have qualified for better loan terms but we were &#039;sold out&#039; by our friendly mortgage broker. Often these terms were switeched at the closing table and people had a choice to walk out or accept the &#039;deal&#039; offerred. Many did not know enough to walk out. 
It makes me angry to think how many people were sold on the ARM when it was not necessary. 
But the public has been brainwashed on the idea that the homeowner bought too much house on a liar loan and therefore deserves to be foreclosed on if default occurs. 
In the case above, the court rightly denied the servicer standing because they did not &#039;own&#039; the note and mortage at the time proceedings began. This is mere technicalities and does not address the fraudulent practices the banks engaged in or bogus documentation. It was a safe call on the part of the court.]]></description>

					<description><![CDATA[One part of the problem, the major part is that the servicer and the fed, insurance and investment industry participated in a process that erased the incomes and credit itegrity that was used to qualify us for the loans in the first place.  There is no statement made in the mortgage that speaks to if lender parties to the agreement cause mortgagor to suffer loss and there should be.  We didn&#039;t cause the melt down - they caused it.   I was looking at article 9 of the constitution that seems to have language that is usable however all parties to an agreement are supposed to be equal to the intent of that agreement.  That is not what is happening now.  I even added an addendum to my loan closing that Wells Fargo Mortgage and its assigns is not to be the loan servicer.  I have had problems with WFB since 1984 and with WFM since pre 2005.  I have contacted lawyers and have decided to go that route.   Going &quot;perse&quot; seems like a faster way for now as I am past 60 with them and have to understand that all of these people have a paycheck to protect.   Some of them even take my objections personally...how funny is that?  Gotta love them anyways or the toxicity will poison me beyond where I am at now.

Told one of them (2 called today...different 2; one from modification and one from payment status) &quot;I wouldn&#039;t want to put on you what my wife and I are going thru now...mentally, emotionally, physically and spiritually&quot; and she replied &quot;I understand&quot;. hi justice i do not know what state you are in but i feel your pain  when the bank rape and do not get arrersted for it i do not undersdtand the mentality of our government entities to keep allowing this to go on.  been through it.  not your story exactly but the fraud and unable to get resolved.   denied hamp by well in 2009 after losing my paper work and having to refax continuously.  redefault after bo spill summer 2010.  again wells fargo moves my  file  being reviewed out of review  and then lose an important package of financial paper work sent Fedex.  i guess they think we are &quot;dumb&quot; and did not count on me saving the tracking number and signee. then they deny my hamp loan again and put me in foreclosure all after telling me they could not help me unless i was in iminemt default.  i have complained to the fla ag, local senator, and the OCC.  nothing done.  just  slap on the wrist and my info foward to them.  all they want to do is reapply me for a mod  its to late property to much money ,underwater  mod needed to done in sept when i was 3 months late.  so this is their faullt  their doing.  a also have gone to the ocunty and their are no assignments,  my 1st trip i asked why their are noassignments registered for my home.  on honey it can take months for assignments to be recorded.  i didnt have the guts to say its been 5 years.   so do not know what i will find at foreclosure court.  i did find appraisal fraud  and found a time and date stamp creditt report from 2/2006 showing a credit score of 789  proving to the judge this is no deadbeat.

so we are all fustrated and do not know where to turn.  my lawyer tells me fraud is hard to prove but hopefully judges are starting to get it.  check  livinglies, neil garfields web site he has a list of lawyers from each state.  its a shame everyone is effected.]]></description>

It adresses the theme of past, present and future evil.  I only suggest it because whatever the outcome we are going to have to continue our lives. &quot;Apolalypse Now&quot; is based on Conrad&#039;s novel&#039;s plot, whatever you think of the movie.  

I love my home tho it is old and needs repairs.  It is a place to lay my head and close the door on a a stressful world.  Or it WAS.  My comments in no way suggest we should not fight.  My husband and I are taking it to court if we have to.]]></description>

withdrawing the check, leaving only enough to keep the account active. Buy and sell using cash only in as many

Educate yourself about finance, all it&#039;s loop holes and scams that can cheat you. Don&#039;t trust anyone who is in the business of stocke, bonds, derivatives, or other virtual games of money. Don&#039;t trust insurance companies, don&#039;t trust title companies, real estate agents/brokers, appraisal agents, inspection agents, or any of the other entities involved in the buying and selling of the real estate market.  If at possible, save up cash, and buy on a personal basis from an individual with the assistance of a good lawyer. 
Right now in this country, there are unknown numbers of homes/properties that do not have clear titles, and
in some cases never will have a clear title because of the improper use/abuse or negligence of not filing each
step of a properties financial changes as they occurred. At least 60 million are now with suspect titles. Those fraudulently foreclosed on and resold are now with unclear titles.  Those who bought and sold these questionable properties knew this before putting them back on the market.  They have been selling hot or
questionable merchandise to the unsuspecting. The damage done to one of our most important rights has 
suffered in some cases irreparable damage. And most of the citizens of this country are not yet aware of the
ongoing scandal and theft because the media has not been responsible in reporting this. When it finally explodes onto the public it will be an awful response of shock and anger.]]></description>
