It seems evident by the decision denying Deutsche the order of reference that this court is aware of the fabrication of evidence that is systemic in foreclosure cases:

"Obviously, the endorsements were made in response to the September 8, 2009 Order, which post-date the commencement of this case (in January 2009), and are ineffective."

Still there have been no criminal charges brought forward.

Certainly a good thing for the court to stop the theft in this case but the court is still completely unwilling to to deal with the larger issue of systemic evidence fabrication, forgery and systemic grand theft.

This is a great article and will be looking up the cases mentioned in it. HSBC for Numora home Equity Trust is mine,I am kind of lucky as I had filed bankruptcy after my foreclosure had been filed. Wells Fargo was the Claimant, and produced an unassigned note to the court in their "proof of claim" . HSBC continued with the foreclosure.I filed a motion, but in a nonjudiciary state, there are different rules about motions. Their lawyer cited not that I did not follow the rules and the case should be dismissed. Of course it was because of that technicality....but the so nicely provided a note which now has a stamp on it "remit to Wells Fargo"...showing that they DID have claim. "Thank you for the help. you just further backed up my claim you are producing evidence". I filed another motion hoping to get a hearing as they said they already sold the home even though my motion was sitting on the docket. We'll see...here's hoping. I proved in other documents they were making them up as they go...but with non-judicial....you have to have the proof and guts to go for it.
