					<description><![CDATA[In Michigan, a party foreclosing a mortgage MUSTown the mortgage debt.  This is a michigan law statue, MCL 600.3204 (a) (d).

According to the 11/15/2010 correspondence of Attorney Jeffrey Vollmer (P62728) who is associated with Wegner and Associates, P.C (St. Clair Shores, MI), the Shiawassee Condominium Association (Southfield, MI) on November 02, 2010 foreclosed on Unit 108 addressed at 25340 Shiawassee and purchased it.  They, Shiawassee Condominium Association before or on November 02, 2010 did not purchase the mortgage debt and did not purchase the mortgage.  This is a direct VIOLATION of Michigan law statues MCL 559.101 and MCL 600.3204 (a) (d).

The Michigan law statue, MCL 559.101 gives condominium liens &quot;superior priority&quot; EXCEPT over first mortgages and/or tax liens.  This requires Michigan condominium associations to pay off any first mortgage and/or tax liens BEFORE not after foreclosure.  Also, the party foreclosing a mortgage must own the mortgage debt.  This is a Michigan law statue MCL 600.3204 (a) (d).  Shiawassee Condominium on November 02, 2010 did not own the mortgage debt attached to Unit 108 at 25340 Shiawassee, did not own the right to foreclose but did and entered into FORECLOSURE FRAUD.

The statue of frauds exist in the law for the purpose of preventing fraud or the opportunity for fraud, not as an instrument to be used in the aid of fraud or as a stumbling block of justice, Cramer v Ballard, 315 Mich 496, 510, 24 N.W.2d 80, 86.

It is professional misconduct for a lawyer [Jeffrey Vollmer] to violate or attempt to violate the Rules of Professional Conduct, knowingly assist or induce others to do so, or to do so through the acts of others.  Reading from the Michigan Rules of Professional Conduct, Rule 8.4 (a).  It is professional misconduct for a lawyer [Jeffrey Vollmer] to engage in conduct involving dishonesty, trustworthiness, or fitness as a lawyer.  Reading from the Michigan Rules of Professional Conduct, Rule 8.4 (b).  A lawyer [Jeffrey Vollmer] licensed to practice in this jurisdiction [Michigan] is subject to diciplinary authority of this jurisdiction. Now that the Florida Supreme Court has amended FLCivPro 1.110(b) - some law firms are starting to squirm.

They&#039;re basically saying to the Court;

We (production shops) filed all these (FAKE) documents and (FAKE) paperwork... we just wanna&#039; say - well, we&#039;d not rather go through with the darn things after all (foreclosing on all those home). Too much work for us now. Do we really have to show our documents... and the accounting and stuff like that?

Thanks... but we&#039;ll pass, maybe next time okay?

**They might as well just fold em&#039; and make a run for the exit. One of the major crime scenes here was our public land records!]]></description>

					<description><![CDATA[The language added by the Florida Supreme Court is a disgrace. It continues to authorize trial courts to grant foreclosure based upon defective, deficient or spurious documents submitted by plaintiff&#039;s counsel in foreclosure. A significant portion of documentation needed to obtain a foreclosure judgment has been shown to be bogus. At the same time,the courts have systematically refused to discipline attorneys who submit bogus documents. The courts want to leave discipline to the Florida Bar Association. The Association has no intention of sanctioning its own attorneys and has voted not to do so.

The same attorneys who in the past have submitted fraudulent documents are now authorized to continue to submit such documents so long as they are willing to lie that the documents are bona fide. This like allowing a counterfeiter to pass counterfeit so long as he represents that that the counterfeit is genuine.  The court is asking the fox to watch the hen house.The result is that no one checks the documents, and the foreclosure mills are given a free pass to continue to abuse the judicial process with bogus documents. 

Ps. How does anyone with a scintilla of self-esteem practice in such a legal environment? Why do the judges in Florida refuse to do the job for which they are paid by the taxpayers? Why do Floridians vote such judges into office year after year?]]></description>
