More recently, I have seen some "open letters" to judges and hopefully the judges' eyes will "open" to the issues that attorneys defending foreclosures and pro se borrowers have been trying to explain. I have likewise stumbled upon the same issues with Deutsche Bank. Thanks for your help and investigation in exposing fraudulent, unfair practices. Keep up the fight.

Has anyone pointed out to the Judges hearing these cases that we are looking at a future time bomb? Since it is apparent that the foreclosing Plaintiffs don't have the authority or right to foreclose, in the coming years, when these houses come up for re-sale, it will be impossible to provide marketable and insurable title!

I state that this is in the future, since currently, the only way to buy an REO (at least in the state of Florida) is if you agree to accept such title as the bank's title company is willing to approve and insure!

Hopefully, the Judges are being made aware of how important it is to ensure that any judgment of foreclosure is absolutely correct!

On another note, I fear the Federal investigation of LPS currently underway may end and stop with Docx. Clearly the template for the fabrication of these assignments of mortgage has been provided by Fidelity, passed on to its spin off LPS, and from there passed on to Docx.

Lynn,

You covered many of the possible routes of the fraud. I expect it is nigh impossible to cover them all. They are creative little buggers.

In my case the assignment, executed 26 months after the closing date of the trust, was executed by then Fidelity employee Laura HESCOTT (Ms HESCOTT is now employed by LPS, as confirmed by Houston attorney Mike Cash). The assignment, and signature of Ms. HESCOTT, were then notarized by Matthew Allan BANASZEWSKI, also an employee of Fidelity at the time (as confirmed by copies of Fidelity's quarterly news letter, "The Summit"). Among the many issues with this purported assignment of mortgage is that the notary signature is not genuine. It looks neither similar nor like any of hundreds of other samples of Mr. BANASZEWSKI'S signature appearing on numerous other baldly fabricated documents used by Plaintiff's to expedite foreclosures. None of these signatures purported to be that of Mr. BANASZEWSKI look similar or like that appearing on his notary signature card on file in Minnesota.

An allonge has also been produced in my case, endorsed in blank. The allonge bears no date of execution, or creation, and no notary signature or stamp. The odds this document is also a bald fabrication are quite high.

As another affront the Trust involved in my case holds itself out to be incorporated in the state of Delaware. Such is expressed repeatedly in its SEC filings. The Delaware SOS, however, has no record whatsoever of it ever being registered in the state.

We all need to keep throwing whatever punches we can. Eventually the hydra will run out of heads. And that hopefully right soon. The rate of foreclosures continues to increase. In the first quarter of this year there have been 80,000 more foreclosures filed than the same period last year. This train isn't slowing down. It seems to be gaining speed.
