Mr. Barlow, keep it up – you are on the right trail. I was surprised that given the Cuomo ruling where SCOTUS defined its ruling in Waters as limited only to the question of whether a subsidiariy of a national bank enjoyed the same pre-emption rights of the parent, Judge Waddoup would rule in the manner he did. SCOTUS specifically stated in Cuomo that the lower courts’ interpretation of Waters is incorrect. So why would would a federal judge rely on Waters?

I suspected something else was behind his decision. Judge Waddoup should have recused hmself – this ruling is invalid. Hopefully, the CoA will rectify this.
