Hi All, I saw the video concerning the MERS mess on another site. However, as I stated on that post, RECONTRUST N.A. WAS able to produce "The Note", so I don't know if this even matters in my circumstance; and perhaps, many others? Replies More Than Welcomed! lahabrabill@roadrunner.com (RECONTRUST is yet another "subsidiary" of BofA.)

ther is fraud in my origination my the front face of my note does not match my mortgage it is a different mortgage product all together. how much did they pay on this note for this phoney default swap agreement and forced my mortgage into default when i payed all my payment. they caused a default event therefore they got paid. this is intentional fraud at closing. like they say they had to defraud the borrower first or they could not have gotten paid any other way

This BK case is not binding precedent in CA. Though this case is correct about how only the owner of the note can foreclose, I have found that CA trial courts are ignoring the own precedents set forth by the CA Supreme Court regarding who may enforce a deed of trust (Cockerell v. Title Ins. & Trust Co. 42 Cal.2d 284, 291, "the note carries with it the security and the trust deed was merely an incident of the debt and could only be foreclosed by the owner of the note." ) and instead throwing these cases out of court.

Overall, a wonderful essay on the current crisis. My only disagreement is that of nationalization of the banks. I believe our first Secretary of the Treasury, Alexander Hamilton, wanted this (someone can correct me if I don't remember my history lessons). I really don't want to see our government responsible for that part of the economy - too much power.

My two cents for the day.
