The Florida Default Law Group has withdrawn a foreclosure affidavit signed by GMAC employee Kristine Wilson, in addition to formerly identified robo-signer Jeffrey Stephan.

Homeowner advocate and Palm Beach County resident Lisa Epstein found a Sept. 14 withdraw of an affidavit related to a foreclosure on a more than $1 million loan taken out in 2006 for a Jupiter-area home.

Wilson signed a foreclosure affidavit in 2009 swearing personal knowledge of the amount owed on the loan and promising that she “is familiar with the books of account and have examined all books, records and documents kept by GMAC Morthgate, LLC concering the transactions alleged in the (foreclosure) Complaint.”

The Sept. 14 affidavit withdraw states “The undersigned law firm has recently been notified that the information in the affidavit may not have been properly verified b y the affiant, and, accordingly, the affidavit is withdrawn.”

Stephan acknowledged under deposition with the law firm Ice Legal that he signed about 10,000 foreclosure affidavits every month swearing personal knowledge of each case, when he did not have such knowledge.

Chase employee Beth Ann Cottrell made a similar admission during a May deposition with Ice Legal. The following is a small excerpt of that depo.

Attorney: So if you didn’t review any books, records, and documents or computerized records, how is it that you had personal knowledge of all the matters contained therein?

Cottrell: Well, I have personal knowledge that my staff has personal knowledge. That is our process.
