					<description><![CDATA[You people.  I mean really, do your own research before you reach foredrawn conclusions.   I&#039;m a licensed process server in FL......thats right, licensed.  As most are in the state of FL.  I make a living serving process.   Oh...thats right...A LIVING!   I SUPPORT MY FAMILY AND PAY MY BILLS.  I am bonded and insured.   If I knowingly fill out a false affidavit of service, I just committed a felony.  Now how many licensed professionals would really go down that route because they can&#039;t get someone served?   Use your heads.  Affidavits of lost original summons DOES NOT MEAN the person didn&#039;t get service of process.  A copy of the pleading is served on the defendant.  The original summons issued by the court is then stapled to my affidavit and filed back at court.   Do you realize how many defendants are filed every month in Duval county....THOUSANDS, TENS OF THOUSANDS.   And yes, the original that goes back to court can and does occassionally get lost, sometimes by the process server, plaintiff attorney, and yes, even the clerk of the court.  That list is looking at 2 YEARS of history.  Also, just because he docket state LOST Original, doesn&#039;t mean an Alias summons wasn&#039;t issue immediately after (look that one up, I&#039;m not explaing it to you bone heads.)]]></description>

					<description><![CDATA[There is something fishy here on the examples provides, Bank NY Mellon and their affiliates. You often see in foreclosure doc&#039;s. Bank New York Etal. &#038; even etc. which is weird but just here in this, there is Bank NY Trust Company , Bank of New York &#038; Bank New York Mellon filing documents. They became one and the same well over 3 years ago.... after which they were given the custodian postion to oversee TARP funds at the TBTF banks.
Just an observation, and this is from one county in Florida.... hummm]]></description>

It&#039;ll probably come as no surprise but many of the people working against the foreclosure gauntlet are loosely connected together: we&#039;ve been communicating and working together for .. I focus on data numbers; data aggregation, analysis, and the conclusions that can e drawn from large sets of data.  The Legalprise database is enormous and it&#039;s constantly growing as we pour more data into it.  It definitively proves the fraud; tying the many pieces of information, broken into millions of little pieces and strewn across the country in thousands of computers, into one large pool of information that can be searched and reported on.  It&#039;s probably most analogous to an anti-MERS; where MERS was built to hide the information Legalprise was built to open it.  We&#039;ll release more and more in the upcoming weeks.

The banks, the mills, and their enablers in government thought they&#039;d be able to hide the fraud by hiding it in thousands of different places, then making those pieces nearly impossible to search as a whole.  Nearly being the operative keyword.  Though just like a well crafted fraud machine of computers built this mess, another machine has been unraveling it: we&#039;ve been working on this for over a year, albeit quietly.  About a dozen high-end servers are unraveling it at an increasingly fast pace.

As you can see from the sample that Michael posted the data is overwhelming: that&#039;s just a tiny sample.  Events that people thought happened only to them were commonplace; not one or two, or ten or twenty, but by the millions.  Bankers (not all, but many) and a bi-partisan coalition of their enablers in government built a consumer slaughterhouse aimed squarely at the American public; we&#039;ve built the tool to tear it down and hold them responsible.  

The data is overwhelming in its scope and the conclusions are self-evident.  Our database simply supports what we&#039;ve been reading in books about the consumer credit meltdown and the Florida foreclosure defense Bar, some of the best in the country, and Michael and Lisa have been showing us in smaller pieces for a long time.  But where the books are abstract -- removed, like a history lesson -- there&#039;s nothing abstract about Stern or Watson or FDLG&#039;s thugs breaking into homes and throwing children into homelessness.  All so that greedy, irresponsible, incompetent, and dishonest bankers wouldn&#039;t suffer losses they knew they were setting themselves up for; so that bankers, not homeowners, could shuck personal responsibility and live well beyond their means.]]></description>

Even if Defendant did file an answer or motion without objecting to the service falure, and even if Plaintiff did gain constructive service, the motion for the summary judgement and notice of the hearing MUST ALSO be served to the correct address, otherwise the hearing is void for defendant was deprived of the right to appear and defend. 
Without proof that the address used on the certificate of service for the motion and notice are correct, (which is hard to do if orignal service was not perfected), the summary judgement is void. 

What is more, the normal 30 day rule for an appeal or one year rule for bringing a motion under 1.540(b) do not apply.  Because... a void judgement is always void, and the passage of time cannot cure.  Defendants can bring a motion to set aside the judgement a &quot;reasonable time&quot; after they find out about the judgement.   

If plaintiff gets a judgement then waits more than a year before attempting to enforce or evict the normal year time limit does not apply, Defendant&#039;s motion to set aside the judgement can be made later, if it is made a  &quot;reasonable time&quot; after they find out. 

TIME

“The final judgment entered upon default in this case awarding unliquidated damages without affording the defaulting party notice and opportunity to be heard is a void judgment.   Under the specific provisions of rule 1.540(b) R.C.P., a motion to set aside a final judgment bottomed upon the reason that the judgment is void is not subject to the one-year limitation but must be brought within a reasonable time.   We glean from the record that defendant’s motion to set aside default and final judgment was filed when knowledge first came to the defendant that the plaintiff was seeking satisfaction of the final judgment.   Such, in our opinion, is within the reasonable time requirement of the rule.”  M.L. Builders, Inc. v. Reserve Developers, LLP, 769 So. 2d 1079, 1081 (Fla. 4th DCA 2000).]]></description>
