When a home is in foreclosure everyone should put a large sign on their roof Stating what bank is foreclosing and to tell all to withdraw there money out of that bank. Take your money out of the banks now.

Make sure they are the same color of RED and make them big so that planes flying over head can see them, Make them at least 18 inches by 6 feet. This would get headlines and make the banks very nervous.

There you have it! Unjustice at its best! Specially in a Judicial State. Can you imagine what takes place in the Non-Judicial States? People are been sent to places like restaurants to spend the whole day through embarrassment, demoralized to the lowest levels, and hurt by the bullies banks' lawyers and retired judges.
First they feed them and then they go through a brain wash and dirty tactics to make them believe they read the depositions and then ignore them to the point you don't know what to think anymore. Finally the judge gets so mad and yell at the defendants to sign the settlement they already agreed before even any negotiations.
It is a take it or leave kind of deal. The winner in this scenario is always the bank since they get the home and the victim homeowner gets to go home empty handed and with his/her head down and swollen eyes from crying the whole time.
California being one of the richest States and being a non-judicial, definitely there is not a due process.
Unfortunately most people do not know their rights, their options, they don't even know what is going on with the banks. Most people don't read about these news in the internet or they never hear about it in the radio or the TV. Sometimes even the most intelligent person who is not into this foreclosure mess, because the economy had not affected them much, they don't care about it. Also many people are so busy trying to make a living just to survive and make their ends meet, they don't have time to read anything or much less to get involve.
The majority of the people when they get the NOD, they just panic, they don't even want to talk about it due to embarrassment and many of them due to their pride. They feel it is their fault and that they left their family down for not being able to make the mortgage payment of their home.
Families start braking apart, fighting for the lack of money to pay their bills. Collectors call every day and the certified letters from the banks or servicers piled up. Many people don't even open the letters. They don't even talk to their neighbors anymore. They don't invite anyone to their homes. It is totally isolation for many of them. Depression kicks in and many of them are so angry they don't want to talk to anybody. They live scare and their stress levels are so high they could kill someone if somebody cross them. The divorce rate and suicides have increased in the last couple of years than any other time in the last decade due to foreclosures.
Just to think this mess will continue next year, why are we killing ourselves working so hard to make the mortgage payments if the lenders or the servicers don't even have the note, sometimes the debt, and most of the time, the note was sold many times to other investors without the assignment or registration of the assignment of the note.
Here is the best kick at the end of 30 years or whenever you finish paying for your home. Try to get the conveyance of the title from the servicer that you thought after paying all this time , they will issue you the title of your home. Good luck with that!
There had been already many cases where the servicer does not have the title or the note, and sometimes not even the debt validation.
How do you like this news now? Have you wonder lately who is the note holder of your note? How do you know if the servicer you are paying the mortgage now has your original note? How do you know how many times your note had been sold in the last 5 years to other investors? Did you get a letter from your first lender letting you know who is the investor who bought your note and for how much they sold it for? How much money did you get from the original lender after he sold your note and specially if you put 20% down payment? Are you angry yet? if this doesn't make you angry, just wait for the next year. Last time I check, MERS has more than 62 million homes in the U.S. and they are also under Fannie Mae and Freddie Mac.
Now do you still wonder why the servicers and the lenders don't want to do loan modifications.
