Gee, the Attorney General is filing lawsuit after lawsuit but I still haven’t heard of anyone who has received any financial relief. We hear about money for discrimination against Countrywide dba Bank of America, money for illegal foreclosures etc but deals are made yet the consumer never receives any compensation. Where does the money go and who’s responsible for disbursing it or does the AG’s office keep it for consumer litigation? I’ve been waiting since 2008 and all I received was a check for $35.00 which was stupid and ofcourse I did not cash it. Who is really going to help us get the compensation we deserve as homeowners who were scammed?

In reply to John. Have you sent them a request (QWR) for the Note Holder? BAC is only a servicing company. They have no right to collect a debt or to foreclose. I can send you what I have sent them, but it needs to be tailored to your circumstances and to your previous communications with B of A.

BofA wrote to me in a letter “you cite no claim that you are entitled to view the original Note, and we are not aware of the existence of any such authority. Accordingly, BAC declines this request…if you wish to pursue this matter, please provide such legal authority.”

Obviously they are wrong here, anyone have the links handy as to the proper response or what should be included in my response?

In reply to J Glenn Lowe. I agree. I personally am suing pro se in Nevada federal court relating to unlawful foreclosure practice. I can reasonably say that the judge in my particular complaint can be accused of mainipulating proceedings on behalf of the bank's benefit in spite of precedent existing otherwise. Seems like fixed situation.

Every lender should be sued by every AG from every state for the very same things. I dealt with GMAC and they told me I had to be 3 paynents behind before they would help me. They had the TARP money and no intention of doing any loan mods etc. I went thru all my money and my perfect credit score of 849 is now down the tubes.

What about filing charges against all of the Men in Black Dresses? (Judges) They have caused all of this by ignoring the fraud that passes under their blind faces every day for years now! Wouldn’t be a need for any of these cases if the law had been working for the people and not the Banksters. Most of the cases would be dismissed on site if anyone were actually following the law and looking at them. The fraud is so obvious in these cases that a child can see it faster than a Judge. Shame, shame, shame on all of them.

Forget calling HUD/Hope for Homeowners. There’s a good chance you’ll get an LPS employee, a fine chance you’ll be asked to submit a bunch of paperwork that will later be used against you, and very little chance you’ll get a meaningful modification; it’s a scam.

Hire an aggressive, competent, foreclosure defense lawyer. Not a non-lawyer “modification expert,” don’t try to “work with” your drunk on on corporate welfare bank. Hire a strong litigator who will fight for you like your banks lawyers have fought for them.
