Yea mine was non-judicial and even though I requested a hearing because of their fraudulent "make it up as we need it" paperwork I never got the hearing. I doubt the judge evn looked at the documentation I presented. Problem is good luck to the homeowner trying to get a lawyer to fight them without having a wad of cash themselves. The banks have have convieniently sucked them dry and have a deeper well to draw from than the homeowner.....they should be prosecuted, but doubt they will because of the homeowner lack of funding.

I don't know where you got your info John, but here in MD that is not the case, when it comes to questioning the banks. I am still amazed to see that homes the bank "repurchased" at the foreclosure sale is being resold by the banks at fire sale prices to new owners.....some over $100,000.00 less the they "paid" for it. Can you tell me that this practice is more fiscally responsible than working with the homeowner you are foreclosing on?
The organization BCC in Boston has the right idea. Those professors pledging their tax write-offs to charities need to set up an organization like that. Helping the foreclosed homeowner rebuy the home with strict rules, but a fair price!

The Banksters better get their bags of cash ready to hand out in the non-judicial foreclosure states and expand their payroll from prosecutors and regulators to judges. After all, only a corrupt judge can keep the banksters from having to face a jury in these civil actions by ignoring the law and pretending that no evidence is in dispute in order to enter summary judgment in favor of the banksters.

In non judicial states it is easier to sue the lending institution and get a jury trial. They had an easy route to foreclosure with no oversight but now must answer to the homeowners peers.

Wait til thee cases start coming to court and see how juries react..
