You are also right that almost every mortgage contract is illegal from the start ab initio. (latin for from the beginning) If the bank lent you money it would be a good contract. But what the bank lent was mostly their credit. Money and credit are not the same thing. A bank is not allowed to lend their credit only their money. There is no bank charter that allows them to lend their credit. Our Constitution says this.
