Homeowners Associations are mini-governments unto themselves. Horror stories abound about the abuses by HOA’s. Whoever created the HOA concept was quite brilliant. Their laws even superce local laws. They are mini municipalies and a horror to be reckoned with. They are untouchable. The web is full of sites dealing with abuses by HOA’s.

The other side of the coin…several of the plats in my area with HOA’s don’t enforce the HOA. A prime example is a small group of about 50 houses in my area that has is ‘common area’ under major power transmission lines. If anyone were to be injured or die in their ‘common area’ since the HOA is not active each homeowner would be at risk of losing everything if a lawsuit was filed. These plats were put in so fast and furious that all laws governing building were thrown out to satisfy the demand for houses to fill up the coffers of the lenders. The people that bought in the plat don’t have any idea of the risk they have taken by buying a home in that area. What the planning department did by approving this plat was take the risk away from the federal agencies that would have the liability under the power lines and hand the risk over to innocent buyers. quite a scam.

The HOA’s that are in efftect are very happy tp take houses from neighbors they don’t like for the slightest mistep. They often have hired attorneys lying in wait.. This case is very interesting and I am sure it is happening all over the country. Perhaps the HOA’s who have been so quick to foreclose on the people in the neighborhood will now get to feel what it is like to have the lenders foreclose on the HOA. I hope they invested all those HOA dues in something other than an MBS.
