The ninth floor of the Palm Beach County courthouse was thick with attorneys Friday as the first case management hearings to determine the status of thousands of former David J. Stern foreclosures began.

Lawyers for the banks, lawyers for the homeowners, and even lawyers handling the transfer of files from Stern’s firm to new firms huddled around a large easel set up outside Circuit Court Judge Meenu Sasser’s courtroom.

There were 500 hearings set for Friday, evenly split between morning and afternoon, and despite a bit of chaos as people searched for their file numbers on the easel, morning operations inside the courtroom ran mostly smoothly.

If in full court room was the over crowding becuase many cases had been docketed at one time, a cattle call, instead of at discrete times? If so the court’s scheduling was at fault and the court should have continued the hearings until it could figure out how to hold them in a bigger court room or scheduled over time so that the court room was not over crowded.

I wonder how the filtering to decide who was admitted into the court room was done. Was the judge aware that people were being stopped at the door?

A letter to the judge in question and the chef judge on the circuit is probably the most effective and expedient way to make a change. The court can, and should, use a larger room or re-schedule, re-docket, so that there is not a mass cattle call which prevents constitutional access to observe.

Failing that the court should arrange close circuit TV to allow all intrested parties to view the proceedings.

I think any letter at the state level will not be well recieved if an attempt to cure it at the local circuit level has not been attempted first.

I suggest you give the local court notice of the problem outside it’s doors and give it the chance for remediation of some sort before pulling the fire alarm.
