Scandalous OneWest Bank and their collection agency now IndyiMac Mortgage Services: I sent IndyMac a $7500.00 cashiers checkd to pay off the notice of default that they had lulled me into by promising me a modification/past due repayment plan. They signed for it on May 5, 2011, they called and left a recording on my voicemail that they received it. But they then proceeded to ignore it and sent me a Notice of Foreclosure anyway, that they did not even bother to sign! I then had a lawyer send them a demand for the payoff amount and breakdown of what was owed. They ignored his letter and demand.I sent them an express demand for payoff and they refused to tell me how much in writing that I owed. I had another lawyer FAX them a demand and they did not give him a breakdown; they’ve been jerking him around for a week and a half, running out the clock until the foreclosure sale on June 17.
A real estate guy with experience with INdymac/OneWest spelled it out for me: they’re keeping my check so I won’t have the money to hire a litigation lawyer and sue them. And by not cashing the check, they can keep adding on false charges, late fees and fake lawyer and handling fees. They know the check is good for 3 months and the bank can’t void it until then. That’s when they’ll cash it, when I’m too broke to fight them in court.
What’s interesting, is that in all of the letters and faxes back in forth, OneWest/Indymac never acknowledges the cashiers check. They never admit they received it;, never say it wasn’t enough;, or sent to the wrong office, or they want to send it back, or another office is dealing with the check.Nothing. That’s just it, that is what is so glaring, by refusing to say anything at all about it, it’s obvious to law enforcement that they are trying to hide guilt.
But until the check is cashed, or until the house is foreclosure sold, there is no grand larceny charge. Most likely they’ve been through this before.
I wish I could get law enforcement here in Los Angeles County involved, get the new Attorney General involved,get this on the radio and expose these felons, get a lawyer I could afford and sue these people, put the suit all over the news.
