The contract terms of the mortgage provide the authority for the entry by those that the Mortgage and note holder hire to do maintenance when a property is neglected or abandoned as provided in every standard contract - it is simply a matter of whether the house is locked and the windows secure and the roof not falling in with or without utilities on, that determines when it is reasonable for someone to enter the property as an &quot;interested party&quot; having interest (by contract in the property).

Inasmuch as this does not involve law enforcement/police there is no requirement for a warrant so do not demand such from a private party.

The alleged inspection report demonstrates that the property preservation crew was either failing to perform and or most certainly negligent if not deceitful in the report for which they were paid to conduct a valid service between the parties as contracted.

					<description><![CDATA[I am having a little problem with third parties entering a home without a warrant. What gives banks the right to pay others to enter your house, even if they believe it is unoccupied.  A friend of mine had this happen. He began staying with a friend because he had a job loss and could not get another paying enought to afford cost of staying in his house.  He had furniture and other things there. Without foreclosing the bank entered and &#039;winterized&#039; the house and continued to visit regularly even though they did not foreclose.  It appears the banks are using a very broad view of when a house is or is not abandoned. 

Like the Robo-signers in which they told these people what they were doing was legal, they seem to be telling these inspectors or investigators that they have a legal right of entry if the house is vacant.  My take on that is they are entering illegally even though they are getting by with it because many homeowners do not prosecute.
This is a slippery slope but another illegal activity taken on by the banks. Are we at risk of being at the mercy of the banks in our &#039;free&#039; country? 
Does anyone remember the saga of little Nell who was tied to the railroad tracks because her family couldn&#039;t pay the mortgage?

Yes, she had family in another state..but it appeared she didn&#039;t need or want a family to watch over her....it was something she alone needed to find and it just wasn&#039;t there to be found.  Taking drugs that a doctor feels is the answer isn&#039;t always the answer...at times it makes the problem worse.  So sad...so close to the beauty of the beach with the morning sun rise to enjoy,  yet  that may have meant nothing to her...maybe in death she found what she wanted and needed....peace.]]></description>
