Shelley, friends of mine who had the pleasure of being foreclosed on by Recontrust a couple of years ago called me about this suit. They now live in another part of the country. Can they still send in their docs to the AG ofiice? And aslo who to and what address should they send them to.

Heard last night on the radio that a homeless shelter in King County in WA will close Aug 15 if they don’t get any funds. Seems the budget cuts will cut out the $40,000 grant the shelter was suppose to get. The banks kick people out of their homes, and then our government kicks the people out of shelters. God help us all.

John, check your public recordings and your closing papers for fraud.. Please don’t re-establish a new debt with any of these crooks…They will re-establish a new debt and throw you under the bus……………………..They no doubt lost track of ownership of your “loan” right after origination……..UCC CODE 3-501 allows the borrower to dicontinue payments WITHOUT DISHONOR until such time as the noteholder or servicer complies with the laws or contract provision….
Law requires each proper mortgage assignment which means- Co. A sells the mortgage to Co. B- to be registered with the county recorder of deeds office.
Attorneys will tell you that the banks do not have to assign and record….That is true if the “lender” DOES NOT WANT TO SECURE THEIR COLLATERAL LIEN….That is why theses are UNSECURE DEBTS AND THEY CANNOT LEGALLY ENFORCE A FORECLOSURE………The ORIGINATION is the most likely place to find where they committed this fatal flaw,and an unsecure debt and massive securities fraud…They sold unsecure notes as security instruments……………………
Also, succeeding purchasers of the fraudulent mortgage securities do have claims against the “Loan” Originator but that would just be a financial claim, not a secured mortgage claim against the property itself-trying to initiate lawsuits against all possible holders of the chain is near impossible. They most likely did you a favor and saved you alot of stress when that balloon payment they would have given you forced you to fail. Then you would have a new secured note to contend with for a home that has really been paid for since origination…….
