I’m not surprised by this situation. Bank of America’s “Retention Department” continued to call me daily for several weeks after the sale date to ask, “What are your intentions in regards to your property at……………..”

Gordon is correct. The bank is the servicer and therefore have violated the FDCPA.

B of A might try to claim immunity as being the “original creditor,” but I think it would be easy to argue that if this is a securitized loan (which seems likely), that B of A, as servicer, is operating as a debt collector.
