This precisely why our forefathers left Europe...to escape Government hoarding and tyranny...! I vent.     .Like I said in Florida they are to prove with the Note in order to foreclose.....now I find it real odd that all the homes in Florida  that the people lost in court......that all those times the bank had the Note...I cannot believe it....maybe a copy of it but not the original....that is what they pulled  in the first foreclosure filing for my daughter....they actually wrote that it was a copy of the original  they held...the judge did not go for it.....
But I did not know that about Nixon...he was not one of my favorite people....I kinda blew him off too...and I did not know the land was sold right from under all of us.....but I believe you...I think more shit has gone on for many years  that  this country has no idea.....like I read where the  National Parks belong to the NWO....not sure who did that....but whoever did it should be hung from the tallest tree in one of the parks...and left for the vultures to feast.  
So you say fee simple was on the foreclosure papers.....I will check my daughters papers  on that.....  well..if someone else owns the land than they can pay to keep it up....and my labor is not cheap.....You know the more I hear the more pissed off I get....it has been nothing but a complete hugh lie and a scam that our  government has done..... just like the World Bank...mid 40&#039;s and the United States President  nominates  the &#039; ceo &#039;  every 5 years..that is who gets the job... and it has always been a U.S. citizen in charge of the World Bank and the United States is the largest shareholder by far in that bank AND the EVIL owns that bank.....an enemy to our country. ....excuse me...something is wrong with this picture......and word has it Hillary Clinton is looking to be the next chosen for that position.....that&#039;s right folks...the U.S. is the biggie shareholder...real cozy with ROME......and than to hear the land is sold from under us....the rabbits hole keeps getting bigger and deeper......and now they...the same evil has robbed the country of everything....as the government played they see no evil, see no evil and speak no evil....]]></description>

Just what are they using or doing  in court to sway the judge?    It appears it .depends  on  how the judge feels that day.....or is it an act of going thru the motions  since it is a court case.?   I think of all the homes that are given  to the banks...this just does not even make  sense.  We are told the frauds are very hard to prove... if at all...and the banks refuse to comply with the Request to Produce...and the courts slide that right by...and the banks cannot produce the original note....and they get the house..... the court is robbing the people of their homes and justice.....rather disgusting......]]></description>

I vent..did you read my comment up above about the note.?...I see where you ask Rob if his lawyers  filed a motion  to compel...Request to Produce..the prima facie evidence.....the Note was destroyed when paid....the copy of the Note stamped without recourse and signed is kept by the bank...the bank lawyers ( Mills) probably get  copies of the note and mortgage. from the title co. from the closing file..to put into the foreclosure summons.....cause in Florida the Note is not recorded...just the mortgage is.......if the Note is destroyed when paid... that there say&#039;s the 2 documents were split...They cannot be split cause that leaves the Note unsecured...BUT  they cashed the note right away...and got paid for something they didn&#039;t invest any money in.....  That makes the contract null and void....and all the payments that they took thru their greed  was a  scam... ..The bank hides the paid note thinking the homeowner will never know or figure out the scam...But there is no original note..at least that is what I have found and figured out.  If there was.... the bank would show it at the beginning of the foreclosure as they are suppose to do...and they can&#039;t....that is why I think you are finding  you need something other than frauds..... Marilyn, did you know that all of the land our homes sit on can be traced back to a Foreign Sovereign?  That&#039;s right...In my fraudclosure filing it says...Interest subject to the mortgage: Fee simple....Did you know that Nixon gave alot of our land up as collateral to the U.N. to free up credit.?..As a result of that the U.N. who is really the Vatican, holds alot of our land in fee simple...Now I traced my lot to landirks who I traced to India and maybe China. But we all know that the Vatican hoarder no doubt found a way to sell interests in our land to other nations just like the mortages..I watched an interview with ex-fed chairman Paul Volker last night...he said China is invested in the mortgages, but indirectly...The U.S Government did not pay back that debt by now?  There is alot of bullshit that has gone on right under our noses by some real traitors..They are causing feudalism in America now over all of their treasonist lies and deceptions...  An alloidal title is where you purchase the land...we are really just renting it..that is why we pay taxes on it...we rent the land our homes sit on and now they want us to rent the house too...they can shove that...dirty crooks...Our tax money paid for these homes....and this land..]]></description>

BTW, Marilyn, in Illinois they have to prove up the note in order to be granted a fraudclosure......I told the pretender lenders attorney the note is unendorsed and that means they have to prove the transfer...My husband told the attorney this was a wet ink note, he smudged the signature in the hall way and the attorney told him no, that smudge was on there....LOL......I know the original note has to be destroyed after they sell it off to Wall Street...and they turn it into a stock...it can&#039;t be converted back to a note...I told the attorney I want to see the PSA and such and such...he said to ask for it in discovery...unless I want to file another motion to dismiss.....It is vertigo out there in foreclosureland. I have to answer by next week...still unsure of what I want to do...I think I want to file a motion to strike the Plaintiffs amended complaint and a motion to dismiss the foreclosure...I have alot of homework to do this weekend....Gotta find the right statutes and and codes and such..I can&#039;t believe they can even bring a foreclosure suit in this State without having filed an assignment...they have to prove up the note to be granted the foreclosure..and they obviously do not have the right stuff or they would have recorded it in the first place..This is all a big farce and all of the attorneys in this state really suck for not helping their fellow man..... Marilyn, I know that by now..they have to show proof of standing and it is very complicated to know what to file if you are not an attorney.These are very complicated procedures...There are very little protections for consumers either, you are going on a wing and a prayer let me tell you...I know all about the original notes being destroyed.I have done alot of homework but that does not make me an attorney and that does not guarantee me from them trying to pull every trick in the book...... They are now trying to enter the &quot;original&quot; note in the second amended complaint and are trying to plead false evidence..Proving they don&#039;t have the prima facie evidence is proving they committed fraud...I am trying to have my case dismissed on the altering of the mortgage contract after the signing and other frauds...not one proper release or assignment has been recorded at the recorders office in 19 years and the clerk at the recorders office told me because of that, my house is paid for..Now I have to convince the Judge....I should not need an affadavit to prove the mortgage was altered, I have the original and the recorded forgery... the fraud is apparent on its face.Altering a contract after signing is a Class 3 Felony in my state...An attorney told me the Judge should give me clear title to my house for that FRAUD......It is easier said than done...These Judges aren&#039;t giving houses away so easy in a courtroom packed with homeowners in fraudclosure...I read on a site that if you ask the lender for the QWR, debt validation letter and go throught the discovery process the bank withdraws their case....This is a complicated mess, I am fighting 2 fraudclosures pro se..My house and my commercial property...and it is incredibly stressful...It is easy to say do this or that but it has to be done right and the Judge has to buy the argument.... What we are doing is, trying to PROVE THEY COMMITTED FRAUD IN OUR NAMES..That is what no standing means...they are trying to take something they have no legal right to take...that is FRAUD.....It is all about the FRAUD, from the Origination Fraud to the Fraudclosure...ONE GIANT  LOAN FRAUD MESS...You have to target the fatal flaw that you think the judge will buy to dismiss the case and it has to be proven. I have been told by an attorney that one fatal flaw in my case  is the altering of the mortgage contract after the closing.They also stamped over forgeries in the fraudclosure complaint which is apparent on its face as well...and I think I know who altered the mortgage contract after the closing.....Chicago Title and Trust..
