The Fraud is definately continuing as of DEC 5th 2011. My husband and I are clearly victims of Foreclosure Fraud. I need help! My husband lost his job in Jan 2010. We tried to work with BAC. Modification, Deed in Lieu, then with the promise of $6,000 cash for Keys we decided to go forward with moving out of our home. They never showed up for the scheduled meeting to give us the money and they would not answer our phone calls. That was on Dec 6, 2010. Merry Christmas! We just learned Nov. 28, 2011 that a nieghbors friend had contaced BAC to buy our home and were told they could not sell it to them as they did not have title. We started looking into the FRAUD. We were not aware of all this. We know now after pulling all of the recorded documents we have been scammed. Mortgage mentions MERS, STERN was BAC’s attorney, Linda Green signed the assignment. Just when we were going to move back into our home a Realtor/friend said he had just listed our home. 12/5/2011, Fannie Mae had taken it over. Now I contacted an attorney who says it is too late as our house foreclosed in Sept of 2010. After a year has pasted it is too late. What can be done to cloud the title. The Realtor has just gotten an contract to purchase my home and should close in FEB 2012. I want to stop this! Is there any help out there?

You were doing everything the modification agreement required, but the foreclosure sale still happened.
Yes, but how do you prove that? the mortgage company can create any kind of documents as we have seen.Our company has 2nd mortgages that we do work outs, so I get to see what the first mortgages do. I do not know how many people have told me that they fill out the paper work fax and have confirmation of the fax -the lender says I never got it. This last couple of months I have had some of my second mortgage customers tell me that they sent the agreement in 6 to 7 times and the lender calls and says they never got it. One man called and said he gave up and was leaving his house he could not deal with them anymore. Just let me tell you who or what two companies are the very worst Bank of America and GMAC. Now if someone puts that on a review and ask BOA or Gmac what do you think they are going to do-produce something to the contrary.

Foreclosure happened while you were in bankruptcy- that is not likely to happen the Trustee or the attorney representing the Debtor is going to catch that. None of the lenders want to be fined or sanctioned by the bankruptcy court.

You requested assistance/ modification submitted complete documents on time and was waiting for a decision when the foreclosure happened- see above- lender will show differently and everyone knows how honest they are. They can document anything.

the foreclosure happened while in active duty- i have not seen that happen. The lenders would have a hard time justifying that or documenting that.

No those reviews will turn out ok. What should have been done was hire enought people not goverment people- to go to each one of these lenders and pull the file. Read the notes most companies document the calls that can be checked. Call the foreclosed person do an actual interview and compare. Check the call records, if the customer said they faxed it get the confirmation- that is something you can trace. that is how the REAL TRUTH WILL COME OUT. I would bet that the lenders are going to get the copies of the reviews and then they can go in and fix everything. It is like getting the answers to the final exam of course they are going to pass.

No one is stopping these crooks from doing it…too many people are believing the lies that if they don’t pay they lose their property..and “someone” is owed this money….! they don’t realize it is the bank who lost their right to collect the day they committed fraud in their names..if they have no legal title there is no legal fix for that…and worse than that there are millions of people paying a mortgage on a property that is now worth less than half of what they paying…and the property taxes are double what they should be because they are still basing the property tax bill on the bubble price…we are paying double for everything because of what these crooks did…! WAKE UP AMERICA!!
