I am a paralegal in Minnesota and work at one the only firms who truly specializes in this area. Actually, I was doing some research when I came across this post. I simply want to urge everyone if your mortgage was held by GMAC, subsequently sold to Ocwen, and following that has a laundry list of transfers, contact an attorney immediately. The trustees for GMAC truly took over GMACs rights, so if you have u.s. bank as trustee for GMAC, it possibly transferred rights it nerve acquired, so any assignments thereafter are null and void.

Thank you.

Perhaps someone can explain to me so I can understand. Deutsch bank filed a lawsuit against me in 2008, nothing was mentioned about the servicer Homecomings, nor GMAC, they also created a robo assignment with Jeffery who supposedly worked with GMAC in Pa. of course prepared by Stern...now Deutch is at it again and using that same assignment they recorded after the foreclosure was filed and dated just before the foreclosure was first filed in 2008...during the time of the first attempt of the fraudclosure, GMAC sent me a letter with one addressed to me attached from Homecomings saying they transferred the servicing to GMAC...both done simultaneously...would appreciate some insights on this please....

Nothing, nothing, NOTHING surprises me when GMAC Mortgage/Ally Bank is involved. We asked for a modification in 2009, GMAC dropped the payment less than $10.00 (yes, ten dollars) per month and then forced us to escrow taxes and insurance which pushed our new monthly payment to over $1,000 per month! They took a "good faith" payment made in the 3rd month of the modification review to repay themselves for the insurance escrow they set up before even receiving the modification paperwork and interest that had accurred in the 3 months! We have yet to straighten the debacle out and we are now 2 years past the original modification request!
