@Todd - You are so right and I agree with you 100%. Chrystal Snow wooped Midland and walked away with a hefty amount. There's another entity, Santander Consumer USA that's getting hit with massive lawsuits dued to their crookedness and greed. Us as consumers need to get educated and fight these monsters back without having any fear, I did. I like to and have passed on to consumers on how to fight back and what to look for in these type of situations. The reason why they get away with it is because so many people don't take the time to invest in getting knowledge on the FDCPA laws and/or our rights. People that cannot afford a lawyer they can do it themselves. With the proper information you could crucify these crooks for sure.

Being in the middle of fraudclosure and fraudcreditcard the statistic that Midland relies upon is the fact that despite all the news about these and other criminals, still 95% of consumers DEFAULT when credit card cases are filed against them.

One demand letter for validation of purported "debt" could blow them out of the water. For any consumer reading this, by just "showing up" you could cut that unacceptable default rate down drastically and put crooks like Midland out of business.

Crystal Snow did it and so can you. We eat the likes of Midland for breakfast without breaking a sweat. Their sham credit card cases are stupid easy to beat the crap out of them and hit them square between the eyes.

For any crooked attorneys, wanker bankers, or Midland shills, reading this you know you are caught and it's only a matter of time before you are put out to pasture.

AG's can get political capital using the likes of Midland as useful idiots, while somewhat running cover for the big banks on fraudclosure.

But, take the wins where you can....

I would also add that the terms of the settlement are almost all things that debt buyers are already required to do. Few of them really do, but they are required. And if they have failed to do any of these things, the alleged debtor probably has a claim against the debt buyer under the Fair Debt Collection Practices Act. The AG is fairly limited in what help it can be in individual cases, so consumers need to get a lawyer that represents them. the AG represents "the people of the state of ___."

Actually, none of the documents linked to in that story is the type of Affidavit that the lawsuit was about. Those are Attorney's Affidavits that they served a complaint and the Defendant did not Answer. The Affidavit's that the lawsuit was about were signed by Midland's "custodian of records" or "authorized representative" and said that the rep had reviewed Midland's business records, and based on those records, the debt was sold to Midland, and that the amount due was X, and the date of the last payment was Y, and so on.
The law firm that made those Affidavits, Messerli & Kramer, P.A., got 14,000 default judgments in 2008, according a to a Minneapolis Star Tribune article. So the level of personal knowledge the 8 or 10 attorneys signing those Affidavits to get Default Judgments couldn't be much better than the robo-signers at midland and the big banks.
