My current case is littered with fraud.(Case No. 13-005031-CI) Patricia Arango fraudulently manufactured “Assignment of Mortgage” through the law firm of Marshall C. Watson (now Choice Legal Group P.A.) Filed it’s case after claiming lost or destroyed note in Jan 2009 then Patricia Arango manufactured the note six months later in June 2009. All are recorded with Ken Burke, Clerk of Court Pinellas County, Florida on July 6th 2009. Refiled new case on May 28th 2013 using same “Assignment of Mortgage”. This case now being handled by McCalla & Reymer LLC which is having complaints in the state of Georgia for alleged fraudulent practices.

The way some of the plaintiff “law firms” “practice law” in the foreclosure divisions is disgusting. This conduct would not be tolerated in any other civil division in any courthouse in the State of Florida. Aside from the robo-signing and falsified documents, some of these firms routinely ignore court orders and don’t provide notice when it’s required by the Florida Rules of Civil Procedure. I’ve watched several judges repeatedly excuse or ignore this behavior, so it’s nice to finally see a judge sanction them.

In reply to BOBBI SWANN. I agree - but I think maybe we need to make judges ELECTED not appointed, and manage to get some of them out of a job. Maybe some of them will then find it a bit hard to make those mortgage payments on their mansions, and maybe they will get a taste of what the common man has endured with everyone trying to steal their home out from under them for the almighty profit of it.

Why would you question whether an attorney would go against the law? Ever heard of all those ‘robo’ signers? Most of them worked for attorneys that represented the plaintiffs….makes no difference which side you’re on. The Florida Bar is sooooo tight it’s like the KKK! I cannot think of one single attorney that has been disbarred here esp. when it’s foreclosure fraud related. Foreclosure Defense Attorney are not held with the greatest of esteem from the courts and for the most part, Judges are in favor of attorneys for the Plaintiff. I mean, c’mon, where are their retirement funds vested? (answer: banks). Who pays for the majority of their campaign funds? (answer: banks) The attorneys are liken to the union….stuck together like glue!

And why is that? I do not understand the ethics of the lawyers, that they would go against the LAW in order to stand firm with the “attorneys of the brotherhood”. Have they all been threatened or bought off by the mortgage lenders and banks? What gives? We have some serious problems in our society when now the “law” is not the law anymore.

Obviously this lender will re-file the case and it will begin anew! I sure hope these people can hold out and Rosen can get a complete dismissal…..Personally, I think a hefty sanction should have been added as well! It’s as though the judge didn’t keep his word when he set this date from the last appearance but then again I don’t see too many judges going against plaintiff’s attorneys…remembering that they are ALL attorneys of the brotherhood!
