In the case of GMAC alias OCWEN, IMPAC reportedly owned the alleged loan but in back of them in some role is Deutsche. Someone said that investment funds and investment banks own these loans. Only the servicer forecloses or handles servicing in most case. In reality, you may not know who actually owns the loan because they were split into so many slivers to diversify risk. Plus it successfully hides many invalid transactions or flawed title with insufficient documentation.

Thanks for the clarification. I knew that Ocwen did supposedly acquire /purchase the old AHMSI / Homeward. The important issue to keep in mind is always the OWNERSHIP of the NOTE as these companies morph and change and constantly try to put on new masks to gain legal advantage.

In many cases in the past, and even now, the difference between the note SERVICER and the note OWNER is intentionally obfuscated for litigation.
I personally recall some foreclosure cases years ago where the Plaintiff was captioned as: AHMSI *formerly known as* Option One”, or where a note or mortgage was conveyed in that name for litigation purposes.
Quite obviously that is a complete LIE.
AHMSI was never Option One Corporation.
AHMSI bought the *servicing rights* of Option One’s notes before it folded back in 2008, and that’s when the “masquerade” began.
Of course LPS was, (and still is) involved and highly instrumental in keeping this and other fictions alive.

I think as we go forward it may become more and more important for foreclosure defense litigators to have a good understanding of the history of these Plaintiff’s. When they claim to be “successor in interest to” or “formerly known as”, it frequently just isn’t true when you dig into the records.

Ocwen is GMAC re-invented. GMAC morphed into Ocwen before it went belly up or in name only.. Even monthly statements are EXACTLY the same as GMAC. Nothing new here. If a corporation made millions or billions in a successful scheme, spent it and moved on then folded, what is to stop them from doing it again and again. Fold the Corp or bankrupt it and reinvent yourself with the same players. Impac and Deutsche are involved. All the same players. Those who believe their loan is serviced or owned by a subsidiary might be surprised to learn that these companies have several ‘names.’ Wells Fargo is also ASC or American Servicing Company and so on. All of these companies have front companies within their operations making it easier to fold one and move servicing to another company as needed to avoid the law.

Be warned though, its like lifting the tail of a skunk.

Option One begets AHMSI which then begets Homeward which then becomes Ocwen, but at the same time Option One changes its name to Sand Canyon, but then is ordered out of business by the state of California in 2009, but is STILL on the books in Florida as “foreign corporation” under the name of “Sand Canyon” and STILL assigning mortgages even the president of Sand Canyon testified in a Federal case back in 2009 that they DON’T OWN any residential mortgages!

You just couldn’t make this stuff up for a movie!
