I am fortunately still living in our home with our two young children and my elderly parents, however it has been 7 years of trying for the LM/ASMPT.
I have been trying to assume the mortgage since they told me I need to, which they waited over 1 year to tell me . My name is on the deed but not the mortgage )They kept me resubmitting for sometime after my husband passed about 2 years of that I received a phone call from yet another new rep ( I have had somewhere around 17 in total , all with different answers .) The right hand has absolutely no idea what the left hand is doing !!!!! I have had 3 attorneys all which have taken my money and not helped at all. I am now on my 4th atty and the same thing seems to be happening more money needed , no answers all the while the loan is getting so big I will never be able to afford it !!! Maybe that has been their plan all along.
My loan /my late husbands was sold 2 years ago to M&T/Bayview Servicing and my experience with trying to assume as well as modify has been no different. It would take me one week to tell you all the craziness in trying to loan mod/ assume I could not make it up if I wanted to !!
Could you kindly recommend an Atty in New York State that is trustworthy and willing to help me sue the bank Please. My oldest soon has been diagnosed now with cancer and I can not loose my home for my children’s sake, they have been through the loss of their oldest brother, their father and now my other son is ill. If anyone has any ideas please call or e mail me. I can make the mortgage payments if they would let me and be reasonable about all the past due amounts.
This has been a war of attrition for me with them for 7 years I am wearing out .
