Freedom Mortgage tried similar actions with my account. After I moved in my home, within months they decided to try to raise my payments over $300 per month. They said there wasn't enough funds in Escrow. After further investigation, I discovered that they would have held over $4,000 extra at the end of the year above what I was required to have in Escrow. They started charging late fees because I was still paying my original payment and I wasn't about to be scammed by another bank. I stopped their auto-pay immediately. They abused it, they lost it. I reported it to OBRE (Office of Banks and Real Estate), FTC, and States Attorney Office. I ran into this many years ago with another mortgage company and they got shutdown. It was found that they were co-mingling funds and using the extra funds in those extra accounts for their own investment purposes, which is against the law. It took about 6 months to get corrected, but I did get all the late fees removed and the Escrow set within the legal limits to cover the taxes and insurance.
Hope this helps.
