I suggest everyone and I mean everyone, in danger of default or not, judicial or non-judicial state check the existence of a recorded deed, mortgage, note or lien. If one was not legally recorded it does not EXIST, according to law, in most states.Or, interestingly enough, a later lien filed and recorded would become primary.  When they check, if one is recorded, verify Notarized affidavits. Some people will be surprised there is NO record of their deed or note OR they may find forged or bogus documents. Whether you are in default or have no problem with payments it pays to check. I know an individual who got a free house like that! 
You never know! If documents aren&#039;t recorded, in most states, there is no legal way to foreclose without going to court.  If you have a clear title, the burden of proof that a lien existed is on the so called lien holder filing suit.]]></description>
