In a decision dated July 23, 2007, Wells Fargo Bank, N.A. v. Gloria Byrd et al., Case No. A0700643, Court of Common Pleas, Hamilton County, Ohio, Keri Selman executed an Affidavit in Support of Summary Judgment on behalf of Wells Fargo Bank, N.A. The Court ruled on behalf of Wells Fargo even though the Assignment of Mortgage from the original lender, America’s Wholesale Lender, had an effective date of more than five months AFTER Wells Fargo filed its complaint for foreclosure and did not seek or receive leave of Court o file a supplement Complaint. The Court ruled that the Byrds failed to show they were prejudiced by the Assignment.

On July 30, 2007, Keri Selman signed a Warranty Deed for a property in Pottawattamie, Iowa, as Assistant Vice President, Countrywide Home Loans, Inc.

On February 23, 2009, The Bank of New York as Trustee for the Certificateholders CWABS, Inc. Asset-Backed Certificates, Series 2006- 22 v. Cremston Myers, et al., Index No. 18236/2008, the Honorable Arthur M. Schack denied without prejudice a Motion for Summary Judgment filed by the bank. The bank was ordered as a condition of renewing its motion to file, within 60 days, “an affidavit by Keri Selman, Assistant Vice President of plaintiff BNY, detailing her employment history for the past three years and explaining why a conflict of interest does not exist where she acted as the assignor of the instant mortgage and note to BNY and served as an officer of assignee BNY; an affidavit from an officer of the original mortgagor, HOMEBRIDGE MORTGAGE BANKERS CORP. [HOMEBRIDGE], explaining whether HOMEBRIDGE was aware of Ms. Selman’s conflict of interest, and if Ms. Selman, in her dual roles as Assistant Vice President of MORTGAGE ELECTRONIC REGISTRATION SYSTMES, INC. [MERS], the nominee for HOMEBRIDGE, and as Assistant Vice President of BNY, fully disclosed to HOMEBRIDGE, the implications of her simultaneous representation of MERS and BNY and the advantages and risks involved…” (footnote omitted).

In a footnote, Judge Schack noted: “Plaintiff’s application is the third application for an order of reference received by me in the past several days that contain an affidavit from Keri Selman…On November 16, 2007, I denied an application for an order of reference (BANK OF NEW YORK A TRUSTEE FOR THE CERTIFICATEHOLDERS OF CWABS, INC. ASSET-BACKED CERTIFICATES SERIES 2006-8 v. JOSE NUNEZ, et al., Index No. 10457), in which Keri Selman, in her affidavit of merit claims to be “Vice President of COUNTRYWIDE HOME LOANS, Attorney in fact for BANK OF NEW YORK.” The Court is concerned that Ms. Selman might be engaged in a subterfuge, wearing various corporate hats. Before granting an application for an order of reference, the Court requires an affidavit from Ms. Selman describing her employment history for the past three years.” In the Myers decision, Judge Schack noted: “This Court has not yet received any affidavit from Ms. Selman describing her employment history for the past three years, whether it is with MERS, BNY, COUNTRYWIDE HOME LOANS, or any other entity.”

On February 13, 2009, Keri Selman signed a Mortgage Assignment as Assistant Vice President, Mortgage Electronic Registration Systems, Inc. to assign a MERS-registered mortgage where America’s Wholesale
Lender was the original lender to Bank of New York as Trustee for the Certificateholders CWALT Inc. Alternative Loan Trust 2006-12CB Mortgage Pass-Through Certificates Series 2006-12CB. On February 17, 2009, Keri Selman signed a Mortgage Assignment as Assistant Vice President, Mortgage Electronic Registration Systems, Inc. acting solely as a nominee for Plute Mortgage, LLC to assign a MERS-registered mortgage to The Bank of New York as Trustee for the Certificateholders CWALT, Alternative Loan Trust 2006-35CB Mortgage Pass-Through Certificates, Series 2006-35CB.

On February 26, 2009, Keri Selman signed a Mortgage Assignment as Assistant Vice President, Mortgage Electronic Registration Systems, Inc. to assign a MERS-registered mortgage where Countrywide Home Loans, Inc. was the original lender to Bank of New York as Trustee for the Certificateholders CWALT Inc. Alternative Loan Trust 2006-13TI Mortgage Pass-Through Certificates Series 2006-13TI.

On April 13, 2009, Keri Selman signed a Mortgage Assignment as Assistant Vice President, Mortgage Electronic Registration Systems, Inc. to assign a MERS-registered mortgage where America’s Wholesale
Lender was the original lender to The Bank of New York Mellon, f/k/a The Bank of New York, as Trustee for the Certificateholders CWALT Inc. Alternative Loan Trust 2006-CB Mortgage Pass-Through Certificates Series 2006-20CB.

On July 28, 2009, Keri Selman signed a Corporate Assignment of Mortgage as Assistant Vice President, Mortgage Electronic Registration Systems, Inc. to assign a MERS-registered mortgage where
Countrywide Home Loans, Inc. was the original lender to BAC Home Loans Servicing, LP f/ka Countrywide Home Loans Servicing, LP.

On November 17, 2009, Keri Selman signed an Assignment of Mortgage as Assistant Vice President, Mortgage Electronic Registration Systems, Inc. to assign a MERS-registered mortgage where
Countrywide Home Loans, Inc. was the original lender to BAC Home Loans Servicing, LP f/ka Countrywide Home Loans Servicing, LP.

On November 17, 2009, Keri Selman signed a Mortgage Assignment as Assistant Vice President, Mortgage Electronic Registration Systems, Inc., acting solely as nominee for Equifirst Corporation to assign a MERS-registered mortgage to The Bank of New York Mellon as Trustee for the Certificateholders of CWALT, Alternative Loan Trust 2004-JO9.

On November 19, 2009, Keri Selman signed a Mortgage Assignment as Assistant Vice President, Mortgage Electronic Registration Systems, Inc., as nominee for America’s Wholesale Lender to assign a MERS registered mortgage where America’s Wholesale Lender was the original lender to The Bank of New York Mellon, f/k/a The Bank of New York, as Trustee for the Certificateholders of CWALT 2004-02.
