Hello everyone I was recently let go from Provest and the illegal actions that I saw within the company are unbelievable. If the attorney general were to investigate they would probably be closed down or better regulated. Affidavits have been forged etc. It is a disgrace that companies can be ran in such matters. Shame on the people that allow these illegal actions. This is no different than the subprime mortgage business there’s no regulation. Its sad to see how people are taken advantage of…

I am a Team lead for Provest and must denounce these alligations. Sure its true that Provest LLC falsifies documents, overcharge clients and has Process servers lie to expidite service and meet our unreasonable deadlines given to us by our great leaders. My manager, Mr. James Wood, (no not James Woods) likes to say “We are doing a great service for the law firms who expect us to do this.” I would have to say that at least 30% of our work has been done in some illegal way. Thanks to our management team, work re-training our employees to “look the other way” as we rape the legal system, repeatedly, has helped Provest reap the rewards. Some major Law firms have already caught on to our practices and have pulled away from Provest LLC, but they will be back. They always come back. Thats why we are one of the top process serving management companies around. I mean, who else will do what is needed to push these bad services and false documents through? In Conclusion, I have to say please, please do not say such horrible things about Provest, It may affect my lifestyle and the only way i will be able to pay for my new home. Please feel free to leave comments to my immediate manager at james.wood@provest.us, but only if you have positive comments about our company. God knows that we could use good comments since even our employees hate it here.

I was going back checking all the documents in my foreclosure case. I knew where there was fraud on the plaintiff’s part, but checking more found many counts of fraud in the service Pro-Vest supposedly did. Didn’t even check here till after and see now the AG is investigating. I will be taking action this week. My attorney was out of town as will be back.
I filed a complaint with the FL AG office in October regarding ProVest and their unethical, illegal practices. I did receive a response from them; however, it was the typical… ‘We are sorry for your troubles and you should contact an attorney’. I already have an attorney…. but we are picking our battles carefully to address the biggest issues in our case. As sad as it sounds, sewer service is not that big of a deal in a foreclosure case.
I guess we can understand why it continues to happen to innocent people. If a federal, or even state, law existed that stated a foreclosure case would be dismissed if it were proven that fraudulent service of process occurred, I believe the lenders would see to it that these illegal acts stopped.
Provest has underminded and ruined the integrity of the indipendent process servers in Broward County. They charge a large amount for not so good service. Pay the employees a minimal amount with pressure all day. Summons are served without any professionalism at all. I hope the Florida attorney general is investigating them.
My husband and I are victims of ‘sewer service’; the bank foreclosed on our property and the foreclosure-mill attorney in Tampa hired Provest to deliver the summons to our home in GA. We learned the summons delivery was in-process and that we had ‘X’ number of days to reply to the courts. We waited, and waited, and waited. After about two months, I contacted the Walton County Clerk of Court and was told our affidavit had been filed two months prior (swearing we received the documents). It was signed by a person I’ve never heard of who claimed to live at our home as a co-resident. That was a lie and we never received our documents as required. Our property would have been sold, without our knowledge, had we not hired an attorney to file a motion and stop the action.
Needless to say, this is only the tip of the iceberg for the fraud and deceit we have uncovered since buying the property in 2005. I can’t imagine the anger and suffering of those that lose thier homes.
Have personalty seen documents claiming to have served the respondent at an address that turns out to be a post office across town, where the respondent did not have a mail box.
Also have case law that says that falure to correctly serve makes any future judgment void. AND the case law say the motion to set aside the SJ does not have to be filed within one year, because, as the opinion states, the passage of time cannot make a void judgement un-void. The standard being made in reasonable time after finding out about the judgement, but not constrained by the normal one year.
Even if the respondent found out and filed the answer, so Plaintiff can claim constructive service or failure in initial service is waived, IF the motion for a summary judgement and notice were mailed to the wrong address then any summary judgement hearing where defendant was not given notice of the hearing is void, because they were deprived of their right to appear and defend. Again void is void and the passage of time cannot cure, allowing both motions to set aside or appeal after the normal time limits have expired. Void is Void and the passage of time cannot cure.
And we know the AG cares very much, right?. After all he has not committed any fraud since we have known him either , right?
The truth is the Miami Dade courts knew about this before any of us did and so did the leaders of our country and our local government, so go figure this out.

TO BENDOVER AND TAKE IT:
If you are a team leader and work at Provest LLC, and you KNOW of illegal activities, you need to report to the Attorney General as your obligation to society. I don’t give a dead turtle if this affects your job. Tuff… What did you do before? Work at Dunkin Donuts or Pizza Hut like another manager and team lead I know.
I am an underwriter, and have been an operations manager, and I have reported illegal practices knowing I would lose my job, and I have, but I sleep better… (not so much the case now, but a few years ago, yes, they love when I catch fraud now) Do you sleep better knowing you have caused people to lose their homes so you can pay your bills? Wise up.
If you continue to work there, knowing they do illegal practices, I have no sympathy for you if you get caught up in some lawsuit and are personally persecuted. YOU ARE A TEAM LEADER, AND COULD BE LIABLE. You would be an assessory to a white collar crime. If you don’t speak up, you are no better than they are. And don’t think the FBI or AG of Florida can’t figure out who you are either, they can link to your email, just as they can to mine.
Of course, knowing the caliber of team leads and managers at Provest, I am not surprised that you are not willing to stand up for what is right. By the way, just posting here may have prompted some “discipline”, I know Provest well. They are the most morally corrupt company I have ever worked for.
For once, do something right, report them to the AG of Florida…. they won’t expose you.

I personally worked for Provest and at first glance, it seemed as if it was an up-to-par organization, but as time went by, I realized that witnessing of Managers referring to a large build, Black man as a Fat Albert cartoon character really showed who they truly are. I did witness a few forged documents, but when I made mention of it, I was told to go do my own work. Honestly, it’s a matter of morals and the culture of Provest is run by friends of friends and they really do not care about abiding by HR and Employment laws either. I was even written up for something that I never did or said and this was only based on an assumption. So why would they abide by other legalities referring to serving affidavits or returns of service? Just a thought. For those who are continuing their efforts of illegal practices within the confines of this organizations “shame on you”, but I knew that the AG would eventually step in. It just took some time to sit back and watch as this all unfolded.
Thank God I left this company! I have learned that when you have executives that only have a high school diploma, you will wind up with that old saying “the blind leading the blind”. I don’t care how much experience they have had in process serving, they need to learn how to lead and lead effectively and efficiently.
