Facing holiday eviction, group protests bank
LONG BEACH, Calif. (KABC) — A group of homeowners facing eviction over the holidays held an emotional rally in Long Beach Wednesday. The group spoke out about the lenders they claim will soon leave them homeless.
At Esperanza Casco’s foreclosed home Wednesday there was a rally to get the attention of the banks.
Thursday, on Thanksgiving day, Casco and her family will officially be homeless.
“We’ve never missed a payment on our home in over 17 years,” said Casco. “But JPMorgan Chase wants to evict us from our house.”
It is the fate of many local families this holiday season.
So Wednesday, with no home to celebrate in, many decided to eat their Thanksgiving meal outside the bank that they say put them in this mess.
“These families shouldn’t have been foreclosed on in the first place because they had stable incomes, and they were eligible for modifications in many cases. In some cases they never missed a payment on their loans. So we’re asking the banks to reinstate their mortgages and certainly not to evict them over the holidays,” said Peter Kuhns, organizer, Alliance of Californians for Community Empowerment.
JPMorgan Chase officials said they can’t comment on each of these cases due to privacy issues, but they are doing what they can to keep these families in their homes.
But due to a recent government-mandated rule, many of these people will have no choice but to be evicted.

We not only never missed a payment our loan was paid off prior to 7/24/03 but from 1998 – 2003 there were over $100,000 in payments not credited to our principal. On 8/04/03 the bank employee filed an improper foreclosure after the bank was sold on 8/01/03. The bank atty almost shit when I provided proof and they gave us an extension to allow us time to get financing while they conducted a internal investigation. That was never done and we endde up with what we thought was a temporary loan. We passed papers on 9/25/03 thru what we later found out was a predatory lender. We were never given our closing papers and tried for 4 1/2 yrs. We finally got them and realized we had a right to rescind our loan. All acts were violated, we made over 150,000 in payments and 0 was applied to the principal. The loan amount and interest rate were different on all papers and our right to cancel was forged. We had our home illegally forclosed and sold without our knowledge on 10/20/08. This was 10 days before our due date which we expressed mailed our payment on 10/29/08 and it was refused and returned to us with no reason or explanantion on 11/06/08. On 11/17/08 it took a rep from Senator Ted Kennedys office to call the bank and they were told that we signed an agreement to change our due date. That was untrue and we were told that we had legal recourse. We spent $40,000 on atty fees and we had a professional witness as well as the facts of law, and depositions. The judge ruled against us in Feb 2010. The bank never sent a notice of foreclosure nor did they place an add in the newspaper. The bank also paid almost 15,000 more than the principal and they were the only bidder and difference is supposed to go to us. We are victims and have all the proof and no where to turn. Our Division of Banks, AG and Office of Consumer Affairs in MA are useless and guilty of dereliction of duty. I am not giving up until Justice is done. The house is still vacant because it is condemned with mold and I brought evidence to the building inspector of our town and he will not allow permits. The subsidiary of the bank is now trying to sell for 30,000 less and not disclosing the facts but I have also been able to put a stop to that. I need advice of who to turn to when you have the proof but no longer have the money to pay an atty.

I have talked to her and she acted like she was interested the vets story but then she just blew me off . I posted on their blod that this site referred us to and the POSt contacted me and then blew me off.
She knows a lot of stuff and has a lot of sources but seems to be only reporting a partial perspective on the reality of the situation.

I am not offering legal advice with this post. I am just a retired disabled Vietnam-era veteran here in portland oregon area fighting to keep my home. I am not in foreclosure or behind in my payments but that doesnt make any difference. I have zero equity in my home and have lost at least $ 250,000 dollars in value since the meltdown of 2008. I have been denied HAMP by JP Morgan Chase/EMC and that is just the tip of the iceberg.
the point of this post is that what I have discovered is that there may be for me relief from all of this in the federal FAIR HOUSING ACT. so I have filed a claim with HUD and Secretary DONOVAN and the regional office in Seattle for alleged discriminatory mortgage practices by JPMORGAN CHASE/EMC.
HUD defines predatory lending as discriminatory and the federal law above provides for attorney fees and full restitution to the homeowner and rep’g against the lender by the u.s. justice department.
well I expected to be allegedly stonewalled by HUD but they have outdone themselves here in the Seattle Regional office and by allgedly Mr. Donovan himself the Secreary of HUD
if we homeowners all filed discrimination complaints with HUD I honestly believe that we would start turing around this situation. but no one is complaining in writing to HUD there have only been according to HUD 34 cases filed.
these cases can wind up in federal court eventually but it gives us a chance to complaint in a statuatory way under federal law at the administrative level with the right of appeal if necessary.
the lenders servicers know about this law and are afraid of the $ 10,000 fine if found at fault.
for one million loans that were allegedgly predatory times the $ 10,000 per loan fine.
that would meean that Chase would be looking at
1,000,000 loans times $ 10,000 per loan or $ 10,000,000,000. that is 10 billion in fines
and on to p of that if those loans are al l found t obe predatory under Community Reinvestment ACt there is another $ 10 billion of fines on top of the previous $ 10 billion.
now do yo uthink that if Chase / EMC had to pay $ 20 billion i n loans that it would get their attention.

I have a suggestion for Vets in this situation. Veteranstoday.com will run your stories as will many of the veterans associations like IVAW (Iraq Vets Against the War). Get your stories to as many of these groups as possible. See if they have any committees to help vets faced with losing their homes. If they don’t, start one and begin organizing protests and inviting your state and federal politicos to them. Videotape these gatherings and put the videos on Liveleak, Youtube and other video feeds. Send the tapes to your local news stations as well. The more noise that you make, the more likely that you will get attention.

They did it to me too: you name it, they did it! they falsified my application, whited out my original information, inserted their own lies after I signed the application- (I’ve enlarged the application to show that the lines in between those lies were whited out and retraced – thus the zig zag of the re-tracing visible as proof of fraud- they inflated my appraisal, (I have proof that the town has appraised and assessed my house $200,000.00 lower that year) they made up a fictitious employment application- unknown by me, signed by them – never seen by me till 4 yrs later- to send to the lender backing up their lies about my salary, inflated it to $7,000.00 more a month, they lied about my profession, the years I worked there, the company’s name- etc. (this 2nd fake application AFTEWARDS- UNSEEN BY ME AND MY ATTORNEY -was sent in afterwards after they whited out the original information I signed under the watchful eyes of my own attorney) they ignored and tossed aside my W-2 that I gave them which proved that I only qualified for a reversed mortgage based on my low income, my age and my financial status -my attorney at the signing stated in a letter of truth that everything I’m saying is true – they inserted afterwards adjustable rate riders and transported my signature- they got me into a STATED-(though I was a simple telemarketer with no right to go stated- had no business of my own and only owned one home- NO DOCS- SUBPRIME- OPTION ARM ADJUSTABLE 8.5% to mature to 11.5%/15.5% (NEGATIVE AMORTIZATION – I would have to pay over a million dollars at the end of the loan from those rising interests rates they put me into) which inserts they included afterwards -My attorney and I never saw those 4 pages -inserts – otherwise she would have never let me sign those forms-till a year later when I asked the lender to fax me the entire application- they refused to give me a copy of my signed application at the end of the refinancing – they refused to modify my loan although I pre qualify according to the Making Home Affordable and presented them with all the required documents- they lured me coherced me, made false promisses -MY ATTORNEY AT THE SIGNING WAS PRESENT (!?!?!?) WHEN they told me to borrow more money that I needed to put in an account at a bank so that the high interests mortgage of 8.5% could pay for itself then he -the broker – would automatically refinance the loan to a low interest rate – a third of my income as in the Making Home affordable- this he said would be the only way I would be able to refinance the house- HE LIED – to me so more. It was my first time refinancing and the broker was my employer-I have those proofs – he lied to me and now is out of business no where to be found- leaving me in this mortgage fraud.They put pressure, intimidate, harrass, bully, stalk you at night by the paking lot after overtime hours when you walk up to your car, they send others to pester you if you hesitate- they hoover over you while you’re working and come nose to nose with you to question you if you should have a minute of hesitation- they threaten to fire you from your job (and if you a senior citizen, THAT IS AN INTIMIDATION- A THREAT !)

One thing that I suggest to everybody is that you go to Youtube and search for Aaron Russo’s interviews where he talks about the conversations that he had with Nicholas Rockefeller. This entire mess was planned by those that want to OWN THE USA. I also suggest that you search YouTube for US Corporation and Sea of Souls to find out what has really been going on for over 100 years driven by the banksters.
The truth is bitter, but at least you will know what has been happening. Then remember that there are hundreds of millions of us and a few thousand of them…stand up and be counted. Begin to withdraw from their system by not spending every penny that you make. Spend only that which you need to survive. Pull your money out of the big banks and put it in healthy local banks.
