Arizona sues Bank of America over mortgage servicing
SAN FRANCISCO, Dec 17 (Reuters) – The state of Arizona has sued Bank of America Corp (BAC.N) alleging the lender consistently misled consumers about its home loan modification process, a source familiar with the situation said.
The lawsuit, filed by Arizona Attorney General Terry Goddard’s office on Friday, accuses Bank of America of violating a 2009 consent judgment in which it committed to widespread loan modifications, according to a draft copy of the complaint obtained by Reuters.
The suit was filed in an Arizona state court. In it, Goddard’s office also accuses the bank of violating the state’s consumer fraud act.

I fear this won’t amount to much. In 2009 Bank of America agreed to a consent judgment over home loans made by its Countrywide unit. Bank of America committed to loan modifications, which it valued at roughly $8.4 billion nationally. However Bank of America lied. It violated its agreement. It did nothing. That’s why Arizona AG Terry Goddard filed his lawsuit.
In November, Terry Goddard was defeated in his run for AZ governor. On 3 Jan 2011 Goddard will be replaced as AG by Tom Horne, a right-wing pro-bankster politician.
When Bank of America cuts a deal with the 50-state investigation (read: whitewash) led by Iowa AG Tom Miller, the new Arizona AG, Tom Horne, will use this deal as an excuse to drop Arizona’s separate lawsuit.
That leaves Nevada’s AG Catherine Cortez Masto, who was re-elected as AG in November. Ms. Masto is not smarter that Goddard of AZ, but she is more fiery.
Of course, everything will become moot if (as I expect) the new Congress passes legislation that retroactively legalizes MERS and bank fraud.
I actually choked up when this scrolled across my TV set.I have been “trying ” to modify my mortgage for two years with B of A. Now ,of course, I know that they have no right to modify.
