US investigates Deutsche Bank in foreclosure case

NEW YORK, Jan 28 (Reuters) – A branch of the U.S. Department of Justice is investigating whether Deutsche Bank (DBKGn.DE) filed false documents and attempted to mislead a bankruptcy judge in a foreclosure action.
Although the investigation involves the case of only one homeowner in Connecticut, a court document filed on Jan. 26 by the United States Trustee’s Office said it wants to elicit information about Deutsche Bank’s practices in general in foreclosure cases.
The inquiry involves Deutsche Bank National Trust Co, the Deutsche Bank unit that acts as trustee for thousands of trusts that invested in mortgage-backed securities. The U.S. Trustees’ Office is a division of the Department of Justice responsible for overseeing administration of bankruptcy cases.
In recent months, the office has stepped up efforts around the United States to block banks and law firms from using false or fabricated documents in home foreclosure actions. The effort follows disclosures in October 2010 of large-scale “robo-signing”, the mass signing of foreclosure affidavits containing “facts” that had never been checked, and wide production of false mortgage assignments.
The Jan. 26 court motion stated that “The United States Trustee has reviewed the documents filed by Deutsche in this case and has concerns about the integrity of those documents and the process utilized by Deutsche in” filing to foreclose.

What was the outcome of this investigation? I can’t find anything . Deutsche Bank used their counterpart DB Structured Products to come into my lawsuit in Dec 2008, stating they bought my loan in Sept 1 2006, from Wamu. My land records show Long Beach Mortgage as owner of my note still in 2010, when DB somehow sold it to a private hedge fund archbay holdings llc 2010b ( 2 robo signers on db assignment) The town recorder cannot understand how this note was sold but the Judge in VT allowed them in 2008 to intervene and take Long Beach place with no proof they owned it .. Only Chase had proof of ownership , in 2011 after I contacted them! Chase had written them both off! Anyone have information ?
I applaud the US DOJ / US Trustee for taking this measure. If you suspect fraud, you should contact the US Trustee in your particular state and your state’s Attorney General. The DOJ and AG offices are independent of each other but my practice is to report suspected fraud to both. Sometimes the reports seem to fall on deaf ears, but as you see in the instant case, the DOJ was watching.
In the instant case, it was the debtor’s attorney who filed an objection to the proof of claim by DBNTC and followed up with notices of deposition and requests for production of documents. The purported creditor responded with a Motion for Protective order to avoid having to actually testify and show the documents. The US DOJ jumped in with their own request for depositions by way f whats known as a “2004 Examination” and demand for documents. It is clear the DOJ was watching over this case and the US Trustee was alert enough to jump in when DBNTC decided to stonewall the consumer. This is why reporting suspected fraud is important.

Also check out the Deutsche Bank law suit, filed last September against CHASE (WAMU) looking to put back lots of mortgages for false representations, grossly substandard underwriting, etc, with their proof being U.S. Senate testimony.
My mortgage is in a Deutsche Bank Trust, “Long Beach 2006-4” which is included in this suit. So I am being foreclosed by CHASE on behalf of Deutsche Bank as Trustee, while Deutsche Bank is suing Chase to put these mortgages back, AND my foreclosure package includes the assignment of my mortgage to the trust in February 2010, YEARS too late because the strict guidelines of the trust require all assignments to me complete way back in 2006!
Is this just a nightmare? It’s just too bizarre to be real!
