Berger & Montague, P.C. Files Class Action Lawsuit Against CitiMortgage, Inc.
PHILADELPHIA, PA, March 16, 2011 (PRNEWSWIRE) — The law firm of Berger & Montague, P.C. has filed a class action complaint in the United States District Court for the District of New Jersey on behalf of all New Jersey homeowners whose mortgage loans have been serviced by CitiMortgage, Inc., and who, since April 13, 2009, (1) have entered into a Trial Period Plan (“TPP”) contract with CitiMortgage and made all payments required by their TPP contract, but (2) have been denied a permanent loan modification agreement that complied with the U.S. Department of the Treasury’s Home Affordable Modification Program (“HAMP”) rules.

The Complaint alleges that CitiMortgage accepted billions in government bailout money under the Troubled Asset Relief Program (“TARP”) earmarked to help struggling homeowners avoid foreclosure. CitiMortgage, like other TARP-funded financial institutions, is contractually obligated to modify mortgage loans it services for homeowners who qualify under HAMP, a federal program designed to abate the foreclosure crisis by providing mortgage loan modifications to eligible homeowners.
According to the lawsuit, CitiMortgage systematically slows or thwarts homeowners’ requests to modify mortgages, depriving borrowers of federal bailout funds that could save them from foreclosure. The bank ends up reaping the financial benefits provided by TARP-funds and also collects higher fees and interest rates associated with stressed home loans.

I AM IN TAMPA BAY FLORIDA i called 3 foreclosure lawyers and one malpractice lawyer and to date no one is calling me back. they must be taking all wells fargos cases from stern and ben ezera. i have been denied ahamp loan fraudulently and have been put into forecloure at the sametime. this is a mess and we are left to the wolfs. every man for himself. i am sick to my stomach. no the answer isnt to move and rent because then they win. oits nor right throwing families into the street when we asked for help. where is our justice so eveyone thinks its ok for a bank to keep losing paper work and moving fikes and foreclosing the same time your tryingto modify your loan??????? come on floridah wake up we need some law suits here
@losing my home in florida: I went to court today to try and stop the banksters from stealing my commercial property and putting it up for sale under my nose. I consulted with a foreclosure defense attorney and he advised me to go ask the Judge for 30 days. The bank did not even show up at court if you can believe that. My husband and I spent 20 in gas and 30 in parking and missed work this afternoon and the bank was a no show. The judge must have went through 30 foreclosure filings and all of the banks and all of the property owners were no shows. Diana Olick from CNBC reported today on the fraudclosed on homes in Chitown that the banks ABANDONED THE HO– USES and now the city is demolitioning these homes. I cannot believe what a travesty this is. All of those people PUT OUT IN THE STREET and all the CITY OF CHICAGO CAN DO IS DEMOLISH THESE HOMES. All I kept thinking the whole time the clerk was handing fraudclosure filing after foreclosure filing to the judge and the banks and the homeowners were no shows is what a disgrace they have made of our country and our laws and our freedom and our justice system. STOP THE FRAUDCLOSURES OBAMA. THIS IS A DISGRACE.

Have you even known a class action where the people most hurt ever got anything but a pittance and were not teed off?
Lawyers get all the money by running up cost. You get the hurt, lawyers get the reward!
If you have a good case for getting good money, there are many lawyers that will take your case for 20% of what they get. You get 80%. Show me that in a class action! Take your case to good lawyers and see what they think. Good lawyers will look at your case for free and tell you if you have a case or not. if they say they will take it, you can bet there is money in it for you.
Now, if the case is just a time wasting bother then the more complainers the better chance for a settlement just to rid the headache right or wrong. Expect a pittance.
