If her records differ from MERS’ records as to who owns the mortgages, legally there is two owners of record under the E-Sign Act. She is a holder of a “transferable record” under the act, as is MERS. If both records are incorrect (which is more often the case), there may be 3 legal owners, all with the same rights as a holder in due course.

She has been lucky that homeowners have not challenged lack of standing in foreclosures based on this law. When homeowners and attorneys become more aware of it, she will not have the same mentality.

What we are seeing in office are those that big business wants there. Yesterday, Tennessee passed tort reform limiting the legal rights of plaintiffs to challenge negligence and place caps on awards for negligence, punitive damages for both medical, product liability, business liability, etc. The Republican majority has also passed restrictions on collective bargaining and tackling unions in Tennessee.
When will John Q public wise up and realize the GOP has only one special interest and that is for big business.
